英国诽谤诉讼及其法律规制

【摘要】：对英国诽谤界定作了历史梳理,并结合其法律规制的历史演进梗概对20世纪以来的诽谤诉讼及其法律规制的一些主要情况作了简要阐述,包括20世纪英国诽谤法中的主要变革,突出的诽谤诉讼和网络诽谤诉讼,以及在西方国家颇具争议的"诽谤旅游现象"等,以期为我国关于诽谤的司法实践与对策研究提供借鉴。
[Abstract]:In this paper, the definition of libel in Britain is reviewed, and the main situations of libel litigation and its legal regulation since the 20th century are briefly expounded, including the major changes in the British libel law in the 20th century. The prominent libel litigation and network libel lawsuit, as well as the controversial "libel tourism phenomenon" in western countries, are expected to provide reference for the study of judicial practice and countermeasures of defamation in China.
