【摘要】:朱熹是继孔子、孟子以来中国古代儒家又一个主要人物,是儒家思想的传人。朱熹是南宋最重要的哲学家、法学家,同时又是举足轻重的政论家。本文主要研究朱熹的法哲学思想,把哲学、法学、历史学三者融会贯通,对朱熹的法哲学思想在前人的基础上进一步探讨。 朱子法哲学思想产生于特定的年代,具有历史根源。南宋的经济和文化极其繁荣,为朱子法哲学的产生奠定了丰富的物质基础和思想基础。同时朱子法哲学思想并非空穴来风,它也是站在前人智慧的肩膀上,对儒家思想的精华进行创造性的总结和提升,是对孔子、孟子、荀子、董仲舒、二程等的思想的继承和发展。朱子法哲学思想是朱熹理论和实践结合的产物,是实践智慧的结晶。朱子热衷于法律实践,在实践中修正自己的法哲学思想。儒家提倡“天人合一”的价值理念,用整体的思维方式来研究世界,为朱熹“存天理,灭人欲”的法哲学思想提供了思想基础。朱熹认为,物欲横流,世风日下是社会罪恶的根源,国家的法律也要遵循“天理”进行改革。朱熹强调“德礼政刑”之间的辩证关系,它们相生相克,相得益彰,处理得当是社会善治的基础。在法律应用上,朱熹主张“以严为本”,恢复肉刑,断其“为乱之本”。其中包含了法家思想的痕迹。朱熹重视民生,关心老百姓的疾苦,朱熹“社仓”思想反映了朱熹关注民生的智慧。然而,在中国古代封建制度下,走不出人治的历史怪圈。朱熹主张任人唯贤,完善官吏选拔制度。总之,朱子法哲学思想是中华法系智慧的结晶,朱熹不愧为中国古代伟大的思想家。
[Abstract]:Zhu Xi is another main figure in ancient Chinese Confucianism after Confucius and Mencius, and a descendant of Confucianism. Zhu Xi was the most important philosopher, jurist and political commentator of the Southern Song Dynasty. This paper mainly studies Zhu Xi's philosophy of law, integrates philosophy, law and history, and probes into Zhu Xi's philosophy of law on the basis of predecessors. Zhu Zi's philosophy of law originated from a specific age and had historical roots. The economic and cultural prosperity of the Southern Song Dynasty laid a rich material and ideological foundation for the emergence of Zhu Zi's philosophy of law. At the same time, Zhu Zi's philosophy of law is not an empty idea. It is also a creative summary and promotion of the essence of Confucianism on the shoulders of forefathers' wisdom. It is a creative summary and promotion of Confucius, Mencius, Xunzi, Dong Zhongshu. The inheritance and development of the thought of two stages etc. Zhu Zi's philosophy of law is the product of the combination of Zhu Xi's theory and practice and the crystallization of practical wisdom. Zhu Zi was keen on legal practice and revised his philosophy of law in practice. Confucianism advocates the value idea of "the unity of nature and man" and studies the world with the whole way of thinking, which provides an ideological basis for Zhu Xi's legal philosophy of "keeping nature and destroying man's desire". According to Zhu Xi, the country's laws should be reformed in accordance with the law of heaven. Zhu Xi emphasizes the dialectical relationship between the "moral politeness and punishment", which is the basis of good social governance. In the application of law, Zhu Xi advocates "strict as the basis", restores the corporal punishment, and breaks its "disorderly foundation". It contains traces of Legalist thought. Zhu Xi attaches importance to people's livelihood and cares about people's suffering. Zhu Xi's "social warehouse" thought reflects Zhu Xi's wisdom of paying attention to people's livelihood. However, under the feudal system in ancient China, there is no way out of the historical circle of rule by man. Zhu Xi advocates the appointment of meritocracy and the perfection of the official selection system. In a word, Zhu Zi's philosophy of law is the crystallization of the wisdom of Chinese law system, and Zhu Xi is worthy of being a great thinker in ancient China.
