立法后评估制度完善研究

【摘要】：随着中国特色法律体系的完善，立法的质量变得日益重要。立法质量密切地联系着人们社会生活，同时也为社会发展提供支持。立法并非越多越好，而是应与社会发展的客观要求相适应，当无法可依的问题解决之后，立法的数量积累到一定程度的时候，就应该把提高立法质量确定为立法的重中之重，而立法后评估制度就是提高立法质量的有效方式和途径。它既体现了科学立法的基本要求，同时又提高了立法过程中的公众参与程度，是近年来各级地方人民代表大会及常委会所普遍采取的一项制度。所谓地方立法后评估制度是指由具有立法权的国家机关在地方性法规或政府规章实施一段时间后，委托评估实施主体按照法定的评估程序，对法律的合法性、合理性、协调性、技术性等指标进行评估并提出维持、修改或者废止等建议的制度。虽然地方立法后评估制度能够切实提高立法质量，增进立法过程中的公众参与，，但是我国目前的立法后评估制度在实践操作中存在着众多的问题，亟需形成相对价值统一的制度规范。
[Abstract]:With the perfection of the legal system with Chinese characteristics, the quality of legislation becomes more and more important. The quality of legislation is closely related to people's social life, but also provides support for social development. Legislation is not the more the better, but should be adapted to the objective requirements of social development, when the problem can not be solved, the amount of legislation accumulated to a certain extent, should improve the quality of legislation should be determined as the top priority of legislation. The system of post-legislative evaluation is an effective way to improve the quality of legislation. It not only embodies the basic requirements of scientific legislation, but also improves the degree of public participation in the legislative process. It is a system widely adopted by local people's congresses and standing committees at all levels in recent years. The so-called local post-legislative evaluation system means that after a period of time after the implementation of local laws and regulations or government regulations by a state organ with legislative power, the evaluation and implementation subject is entrusted to carry out the evaluation in accordance with the legal evaluation procedures, and to the legality, rationality and coordination of the law. Technical indicators are evaluated and recommended systems for maintenance, modification or repeal are proposed. Although the local post-legislative evaluation system can effectively improve the quality of legislation and enhance the public participation in the legislative process, there are many problems in the practice of the current post-legislative evaluation system in China. It is urgent to form a unified system of relative value.
