现行立法监督程序启动保障机制三十年之启示与其完善

【摘要】：立法监督制度在现行宪法中得到定位,程序启动的保障机制远未齐备。宪法施行以来的制度实践屈指可数,官方启动集体失语,民间启动缺少权威。对比西方发达的法治化模式,我国的现有机制也非乏善可陈,立足现有资源并扬长避短,才能获得立法监督程序启动保障机制的根本改观。
[Abstract]:The system of legislative supervision has been positioned in the current constitution, and the safeguard mechanism of procedure initiation is far from complete. Since the implementation of the Constitution, few institutional practices, official collective aphasia, lack of authority. Compared with the developed mode of rule of law in the west, the existing mechanism of our country is not without merit. Only by basing on the existing resources and taking advantage of the advantages and circumventing the weaknesses, can we obtain the fundamental improvement of the mechanism of the legislative supervision procedure.
