浅论中国传统刑律儒家化

【摘要】: 中国传统刑律的儒家化可以说正式滥觞于西汉中期,纵贯魏晋南北朝,到隋唐时期逐渐成熟并定型下来,有些重要制度为宋元明清各代所袭取,贯穿到中国古代社会的解体。中国传统刑律儒家化的表现是诸多方面的。它是一个动态的发展过程,每个历史时期刑律的儒家化都不是完全的照搬以前的成果,都有其自身的新内容。当前的中国社会终究受到传统文化的巨大影响,因此法治建设也应当对刑律儒家化过程中很多优秀思想和制度予以有益借鉴,继承其至今仍有合理性的成分,抛弃其糟粕。尽管这种借鉴并不能称为真正意义上的刑律儒家化,但在某种意义和程度上可以说是它的延续。目前学界对于这一问题的研究较多,鉴于此,本文即着重在于对传统刑律儒家化的研究现状、立法司法表现以及对社会的影响等方面进行一个大致的梳理,以期对这一问题有更多的了解,重新发掘一下其对现代法治建设的借鉴意义。
[Abstract]:The Confucianization of the Chinese traditional criminal law can be said to have originated in the middle of the Western Han Dynasty, running through the Wei, Jin, Southern and Northern dynasties, and gradually maturing and finalizing in the Sui and Tang dynasties. Some important systems were inherited by the Song, Yuan, Ming and Qing dynasties, and ran through the disintegration of the ancient Chinese society. The Confucianization of Chinese traditional criminal law is manifested in many aspects. It is a dynamic development process, every historical period of the Confucianization of criminal law is not completely copy of the previous achievements, have their own new content. The current Chinese society has been greatly influenced by the traditional culture, so the construction of the rule of law should benefit many excellent thoughts and systems in the process of criminal law Confucianism, inherit its reasonable elements and discard its dross. Although this kind of reference can not be called true criminal law Confucianization, it can be said to be its continuation in some sense and degree. In view of this, this paper focuses on the research status quo of the traditional criminal law Confucianization, the legislative and judicial performance and the impact on the society, and so on. In order to have more understanding of this problem, rediscover its reference significance for the construction of modern rule of law.
