论中国传统法律的伦理特色

【摘要】：中国传统法律起源于夏商时代,至清末变法修律终结,历经四千多年,稳定的法律结构在世界上是罕见的。对于中国传统法律的特征,学者们见仁见智,从不同角度各抒己见,而关于中国传统法律的伦理特色,其发展历程、主要表现、形成原因以及价值和对当代立法的借鉴意义,则被大多数学者所认同,甚至有学者称其为伦理法或儒家法。
[Abstract]:The traditional Chinese law originated from the Xia - Shang Dynasty , and the legal structure of stable legal structure has been rare in the world over the past four thousand years . As for the characteristics of Chinese traditional law , scholars have shown the ethical features of Chinese traditional law , its development course , main expression , formation cause and value and the reference significance to contemporary legislation , and even scholars say it is ethical or Confucianism .
