上下班途中非道路交通事故受伤是否构成工伤

【摘要】：正案情简介张某骑自行车下班行至乡、村自行修建的道路,与同样骑自行车的他人相撞,张某感觉伤势不严重,对方未受伤,双方均未报警。张某回家后,膝盖疼痛加重并肿起,去医院急诊结果为"左膝后缘股骨折",在家休息2个月,后张某要求认定为工伤。用人单位对张某在下班途中受伤的事实没有异议,但认为张某对事故有过错不应当认定为工伤。
