文若其人:赵舒翘与《提牢备考》互证——兼论中国法律史的研究方法

【摘要】：由清末名臣赵舒翘所著的《提牢备考》被誉为中国历史上第一部监狱法规汇编。正所谓文若其人,《提牢备考》的编写正是赵舒翘一生为人、为官、为学、为道的理想和追求的体现。赵舒翘所具备的"正直、勤勉、谨慎"等优秀品格使他编写《提牢备考》顺理成章,并且在《提牢备考》的结构安排上也充分展现了他的人品和学养。通过综合运用描述性和解释性的法律史研究方法对赵舒翘与他的《提牢备考》进行互证研究,可以真切地把握作者赵舒翘和作品《提牢备考》及社会语境三者之间的内在关联,从而实现对赵舒翘这一清末律学翘楚和具有开山之功的监狱学著作《提牢备考》的"深描",进而深化对人物和作品的认知。这一方法当成为对既有中国法律史研究的补强。
[Abstract]:Zhao Shuqiao, a famous official in the late Qing Dynasty, was praised as the first compilation of prison laws and regulations in the history of China. It is the ideal and pursuit of Zhao Shuqiao's life to be a man, an official, to learn, to learn and to pursue the Tao. Zhao Shuqiao's excellent character of "integrity, diligence and prudence" makes him write the "preparation for the exam for a prison", and it also fully shows his character and education in the structural arrangement of the preparation for the examination. Through the comprehensive use of descriptive and explanatory methods to study the legal history of Zhao Shuqiao and Zhao Shuqiao and his "preparation for the examination of the proposed prison", we can truly grasp the inherent relationship between author Zhao Shuqiao and his work, the preparation for the examination in prison, and the social context. In order to realize Zhao Shuqiao, who is the leader of the law study in the late Qing Dynasty, and who has the work of opening up the mountains, the "deep description" of the prison works, "the preparation for the introduction of the prison", is realized, and the cognition of the characters and the works is deepened. This method serves as a complement to the existing study of the history of Chinese law.
