中国五四宪法和苏联三六宪法比较研究

【摘要】： 五四宪法是新中国历史上第一部真正的社会主义类型的宪法,尽管它早已失去了效力,但它所确立的国家性质、国家的根本政治制度、国家结构形式、国家机构、公民的基本权利义务等基本内容和结构基本上为以后的每部中国宪法所继承。因为当时的历史背景和国际环境,五四宪法的制定基本上是以苏联三六宪法为蓝本的,在许多方面斗借鉴了苏联三六宪法的规定。但五四宪法同时又从中国国情出发,大胆创新,具有许多与苏联三六宪法不同的内容。因此,五四宪法的制定较好地体现了国际化和本土化的结合。因而在对五四宪法与苏联三六宪法的比较中来解读我国五四宪法,有助于我们更深刻地理解五四宪法的本质、制宪观念以及具体制度,有助于我们探索我国宪法及宪政发展的历程,并进而促进我国宪政的发展到更高的阶段。
[Abstract]:The May 4th Constitution is the first true socialist constitution in the history of New China. Although it has long lost its validity, it has established the nature of the country, the fundamental political system of the country, the form of state structure, and the state organ. The basic contents and structure of citizens' basic rights and obligations are inherited by every Chinese constitution. Because of the historical background and international environment at that time, the constitution of the May 4th Movement was basically formulated on the basis of the Constitution of the Soviet Union, and drew lessons from the provisions of the Constitution of the Soviet Union in many respects. But at the same time, the Constitution of May 4th starts from the national conditions of China and innovates boldly, which has many different contents from Soviet Constitution. Therefore, the constitution of May 4th embodies the combination of internationalization and localization. Therefore, in the comparison between the May 4th Constitution and the Soviet Union's sixth Constitution, the interpretation of the May 4th Constitution will help us to understand more deeply the essence of the May 4th Constitution, the concept of constitution and the specific system. It is helpful for us to explore our constitution and the course of constitutional development, and then to promote the development of our constitutional government to a higher stage.
