少数民族习惯法与政府行政行为研究

【摘要】：我国是一个统一多民族国家,各民族在长期的历史发展过程中创造了具有本民族特色的民族文化,以及相应的少数民族习惯法。少数民族习惯法作为习惯法的重要组成部分,是我国广大少数民族通过多年来的生产生活与实践活动逐渐形成的,并不断发展而为本民族成员所信奉和遵守的一种行为规范。 正是因为少数民族习惯法的长期存在,少数民族习惯法已经根植于其民族内部,并长期作为少数民族的一种法律规范。所以,少数民族习惯法在少数民族地区仍然体现出了极强的生命力。因其长期存在于民族内部,所以少数民族习惯法更贴近少数民族人民的日常生活,更得到了少数民族人民的普遍的尊重与认同,而国家法及其引导下的政府行政行为并不能完全适用于少数民族地区,当少数民族习惯法与政府行政行为发生摩擦与冲突时,国家法很难得到当地少数民族人民的认同,也导致了部分政府行政行为很难得以开展。虽然两者存在冲突,但在一定程度上也存在着互动的关系,当少数民族习惯法与政府行政行为目标一致时,正是因少数民族习惯法是经历的长期的演变以深入少数民族人民内部的一种文化。所以,其必然对当地政府行政行为起到促进的作用。 所以,为推进我国少数民族地区的法治建设,要充分发挥国家制定法与少数民族习惯法在各自领域内的重要作用,促进两者间的融合与发展,对少数民族习惯法中的良性因素加以肯定,通过借鉴少数民族习惯法对于少数民族地区管理的智慧,合理的对少数民族习惯法中的良性因素加以利用,并进行吸纳与结合,以此寻求少数民族习惯法与政府行政行为的共生发展。

The identity of the ethnic people also leads to a rare administrative act of the government. Although there are conflicts between the two, there is an interactive relationship to some extent. When the customary law of ethnic minorities is consistent with the government's administrative actions, it is precisely because the customary law of ethnic minorities is a long and long-term evolution of the ethnic minority people. A kind of culture. Therefore, it is necessary to promote the administrative behavior of local governments.
Therefore, in order to promote the construction of the rule of law in the minority areas of our country, we should give full play to the important role of the national law making and the customary law of ethnic minorities in their respective fields, promote the integration and development of the two, affirm the benign factors in the customary law of the minority ethnic groups, and learn from the customary law of ethnic minorities to the management of the minority areas. Wisdom and rational use of the benign factors in the customary law of ethnic minorities, and absorb and combine them in order to seek the symbiotic development of the customary law of ethnic minorities and the administrative act of the government.
