法律内在道德的理论分析——简评富勒《法律的道德性》

【摘要】：法律的内在道德被公认为是美国法学家富勒新自然法思想的精义所在,应当从三个依次递进的方面予以理解和把握:法律内在道德的提出有其特定的多方面条件;法律内在道德的展开有其独特的理论进路与学术内涵;有关法律内在道德的论战,丰富并发展了论战双方的思想体系,为法理学知识的增进做出了创造性的理论贡献。
[Abstract]:The inherent morality of law is recognized as the essence of the new natural law thought of American jurist Fuller, which should be understood and grasped from three aspects in turn. The development of the inner morality of law has its unique theoretical path and academic connotation, and the controversy about the inner morality of law enriches and develops the ideological system of both sides in the debate, and makes a creative theoretical contribution to the enhancement of the knowledge of jurisprudence.
