从多种翻译理论的角度论法律翻译

【摘要】： 本论文主要针对不熟悉法律语言的译者和对法律语言有兴趣的人士,通过阐述法律语言的特点,尝试提出法律翻译的原则,借助多种翻译理论为理论指导,对法律翻译进行研究。首先,作者提出了论文的理论基础。乔姆斯基的普遍语法以及语言之间的共性使得翻译成为可能。只有在语言可译性的前提下才有研究法律翻译的必要。熟悉法律语言是进行法律翻译的前提。为了使读者对法律语言有更好的了解,作者在这个部分里从文体,词汇以及句法层面上对法律语言的特点进行分析。作者通过大量分析,为读者揭开了法律语言的神秘面纱。作者在第三部分分别阐述了严复的翻译理论、泰特勒的翻译理论、卡特福德的翻译理论、纽马克的翻译理论以及奈达的翻译理论,并且试图将这些翻译理论应用到法律翻译中。最后,作者提出了四条法律翻译原则,并且借助大量的例子对它们进行分析,以期该四条原则能在读者进行法律翻译的过程中起一定的帮助作用。
[Abstract]:This thesis aims at the translators who are not familiar with the legal language and those who are interested in the legal language. By expounding the characteristics of the legal language, this thesis tries to put forward the principles of legal translation, guided by a variety of translation theories. To study the translation of law. First of all, the author puts forward the theoretical basis of the paper. Chomsky's universal grammar and linguistic commonalities make translation possible. It is necessary to study legal translation only on the premise of language translatability. Familiarity with the legal language is the prerequisite for legal translation. In order to get a better understanding of the legal language, the author analyzes the characteristics of the legal language from the aspects of style, vocabulary and syntax. Through a great deal of analysis, the author uncovers the mystery of legal language for readers. In the third part, the author elaborates Yan Fu's translation theory, Tytler's translation theory, Catford's translation theory, Newmark's translation theory and Nida's translation theory, and attempts to apply these translation theories to legal translation. Finally, the author puts forward four principles of legal translation, and analyzes them with a large number of examples, hoping that the four principles can help readers in the process of legal translation.
