远程公路建设再融资模式研究:从德国法律视角的考察

【摘要】:远程公路的建设和运营因为需要大量的资金,使囊中日趋羞涩的公共部门不得不寻求与私人部门的合作,作为一种新型的制度安排,公私合作制开始在交通基础设施领域渐成潮流。为了扫除在该领域内的法律障碍,德国政府通过《公私合作制促进法》对远程公路建设私人融资作出了新的规定。在再融资的问题上,私人部门开始拥有了收费模式和酬金模式的选择权。文章从法律的视角,探讨了相关问题的立法背景和实践操作,就两种模式的优缺点进行了分析比较,并得出酬金模式更有利于运营者的初步结论。
[Abstract]:The construction and operation of long-distance roads, which require a great deal of money, have forced the increasingly shy public sector to seek cooperation with the private sector as a new type of institutional arrangement. Public-private cooperation began to become a trend in the field of transport infrastructure. In order to remove the legal obstacles in this field, the German government has made new regulations on the private financing of long-distance highway construction through the "Public-Private Cooperation Promotion Act". When it comes to refinancing, the private sector is starting to have options for charging and fees. From the perspective of law, this paper discusses the legislative background and practical operation of the related problems, analyzes and compares the advantages and disadvantages of the two models, and draws a preliminary conclusion that the gratuitous model is more favorable to the operators.
