日本死刑适用中公共舆论的影响

【摘要】：日本是保留有死刑制度的国家,对此日本公共舆论一直保持着支持态度。同时,公共舆论对日本死刑相关制度的改正和具体适用也产生了具体影响,例如因公共舆论的影响在立法上改正了死刑之公诉时效的限制等。但公共舆论对死刑制度的支持并不意味着公共舆论是在对死刑制度充分了解的基础上做出的,政府当局情报公开的不充分性,使公共舆论并不十分清楚死刑制度的全貌尤其是死刑执行制度。未来,日本应更加推进关于死刑的情报公开,使公共舆论在充分了解死刑制度的基础上迈向对死刑废除的支持。
[Abstract]:Japanese public opinion has always been supportive of Japan's retention of the death penalty system. At the same time, public opinion has a specific impact on the correction and application of Japanese death penalty system, for example, it corrects the limitation of the statute of limitations of public prosecution in legislation because of the influence of public opinion. However, the support of public opinion for the death penalty system does not mean that the public opinion is based on a full understanding of the death penalty system. So that public opinion is not very clear about the death penalty system, especially the execution of the death penalty system. In the future, Japan should further promote the disclosure of information on the death penalty and make public opinion move towards the abolition of the death penalty on the basis of a full understanding of the death penalty system.
