本科法学教育人才培养模式研究

【摘要】: 高等法学教育是我国高等教育体系的重要组成部分,是进行民主法制建设的先导性工程,它关系到“依法治国”方略的实现,关系到社会经济、政治秩序的稳定和人民的安宁。本科法学教育是高等法学教育的起点,承担着为社会输送大批法律人才,及为研究生教育培养后备人才的重任。自改革开放至今,尤其是在上个世纪90年代高等教育大众化趋势的推动下,我国本科法学教育的发展取得了举世瞩目的成就,然而,在看到成绩的同时我们也应该清醒的认识到,随着社会关系日益复杂化,原有的单一的本科法学教育人才培养模式已不适应时代发展要求,表现为:一方面社会急需高端的优秀法律人才,另一方面法科毕业生却成为当下就业最难的学生群体。本文针对本科法学教育人才培养模式存在的问题,尝试着提出了分段分类构建措施。全文分为四章: 第一章:绪论。简述了本文的选题目的、意义,选题的理论依据,研究的思路、方法和国外本科法学教育发展现状及对我国的启示。 第二章:人才培养模式理论简述。该章内容是全文的理论支撑,首先简单概括了人才的概念、特征,模式的概念,接着详述了人才培养模式的概念及特征。在总结、借鉴不同学者的理论观点基础之上,提出了人才培养模式的四个构成要素。 第三章:当前我国本科法学教育人才培养模式存在的问题及其成因分析。指出了当前我国本科法学教育人才培养模式主要存在的问题,从三个方面对产生问题的原因进行了分析。 第四章:我国本科法学教育人才培养模式的构建。指出了我国本科法学教育面临的时代背景,构建本科法学教育人才培养模式遵循的原则和总体思路,紧紧围绕着人才培养模式的构成要素较为详细的论述了构建分类分段培养模式的具体措施。
[Abstract]:Higher law education is an important part of our country's higher education system and a leading project in the construction of democracy and legal system. It is related to the realization of the general plan of "governing the country by law", the stability of social economy, political order and the tranquility of the people. The undergraduate law education is the starting point of higher law education, which undertakes the task of transporting a large number of legal talents for the society and cultivating reserve talents for graduate education. Since the reform and opening up to date, especially under the promotion of the trend of popularization of higher education in the 1990s, the development of undergraduate law education in China has made remarkable achievements, however, At the same time, we should also realize soberly that, with the increasing complexity of social relations, the original single mode of cultivating undergraduate law education personnel has not been able to meet the requirements of the development of the times. On the one hand, the society is in urgent need of high-end legal talents, on the other hand, law graduates have become the most difficult group of students to obtain employment. In view of the problems existing in the training mode of undergraduate law education talents, this paper tries to put forward the measures of constructing segmental classification. The full text is divided into four chapters: chapter one: introduction. This paper briefly describes the purpose, significance, theoretical basis, research ideas, methods and the development status of undergraduate law education in foreign countries and its enlightenment to our country. The second chapter: the theory of talent training model. This chapter is the theoretical support of the full text. Firstly, it summarizes the concept, characteristics and model of talent, and then details the concept and characteristics of talent training model. On the basis of summing up and drawing lessons from different scholars' theories, this paper puts forward four elements of talent training mode. Chapter three: the problems and causes of undergraduate law education in our country. This paper points out the main problems existing in the training mode of undergraduate law education talents in our country at present, and analyzes the causes of the problems from three aspects. Chapter four: the construction of talent training mode of undergraduate law education in China. This paper points out the background of the undergraduate law education in our country, and sets up the principles and the general ideas of the talent training mode of the undergraduate law education. This paper discusses in detail the concrete measures of constructing the classified and segmented training model around the constituent elements of the talent training model.
