农地征收中的精神损害补偿问题研究

【摘要】：农地征收中的精神损害补偿是指国家对因其合法征地行为而给被征地农民造成之精神损害所进行的救济。在我国构建此种制度的理由,除了包括相应法理依据和法律依据外,还包括目前域外已有在土地征收过程中实行精神损害补偿制度的先例等。农地征收中的精神损害补偿方案主要包括:坚持精神抚慰为主、自由平等协商和法官自由裁量等补偿原则;实行给付精神损害补偿金、尽可能复制生活环境和定期进行心理疏导等补偿方式;以被征土地的使用属性、使用年限、经济价值、被征地农民的文化适应难度和当地生活水平等作为确定精神损害补偿金数额的参考因素。
[Abstract]:The compensation for spiritual damage in farmland expropriation refers to the state's relief for the spiritual damage caused to the farmers who have been expropriated because of its legitimate land expropriation. The reasons for the construction of this system in our country include not only the corresponding legal basis and legal basis, but also the precedents of the spiritual damage compensation system in the process of land expropriation outside the country. The compensation schemes of spiritual damage in farmland expropriation mainly include: adhere to the principles of spiritual comfort, free and equal consultation and judges' discretion; We should pay compensation for mental damage, copy the living environment as much as possible and carry out psychological counseling on a regular basis. The use attribute, service life, economic value, cultural adaptation difficulty and local living standard of the land expropriated farmers are taken as the reference factors to determine the amount of compensation for spiritual damage.
