美国植物新品种保护制度对我国的启示

【摘要】： 植物新品种来源于人们的劳动,它作为人们的劳动成果对社会产生了巨大的经济价值和社会价值。随着育种技术的不断进步,以及对优良种子的需求和依赖性强度的增加,极大地刺激了育种者对植物新品种的开发投入,也因此在客观上引起了国家对植物新品种的重视。作为农业和人口的大国来说,加强植物新品种的保护自不待言。 本文以植物新品种为对象,通过对美国和我国植物新品种保护制度的比较分析,检讨我国的植物新品种保护制度。笔者以知识产权的利益平衡为角度,结合美国的经验,深入探讨该制度中涉及的各种问题,以期对我国的植物新品种保护制度提出可行性建议。同时我们相信,充分利用现有的法律和立法技术,同样能达到异曲同工之效。
[Abstract]:The new plant variety comes from people's labor, which has great economic value and social value to the society as the result of people's labor. With the continuous progress of breeding technology and the increase of demand and dependence on fine seeds, the input of breeders to the development of new plant varieties has been greatly stimulated, which has objectively attracted the attention of the state to new plant varieties. As a large agricultural and populous country, it is not necessary to strengthen the protection of new plant varieties. Based on the comparative analysis of the protection system of new plant varieties in the United States and China, this paper reviews the protection system of new plant varieties in China. From the point of view of the balance of interests of intellectual property rights, combined with the experience of the United States, the author deeply discusses the various problems involved in the system, in order to put forward feasible suggestions for the protection system of new plant varieties in China. At the same time, we believe that the full use of existing legal and legislative technology, can also achieve the same effect.
