法庭提问中叙事话语的衔接与关联

　　本文用实证的方法从衔接和关联的角度研究法庭叙事话语。文章主体分为叙事话语的衔接和关联两部分,每个部分都涉及到了中英文的法庭语料。 衔接和关联都是法庭叙事的重要特征。衔接理论用于律师和证人的独自分析,而关联理论用于律师和证人的对话分析。在庭审过程中,法官或陪审团,辩护律师,原告,被告和证人用问答话语结构共同参与构建片断形式的叙事话语。辩护律师使用各种策略使己方的故事合理可信。在直接询问阶段,辩护律师侧重使用开放式的疑问句,提供给证人更多构建叙事话语的空间和自由度。在交叉询问阶段,辩护律师多用强引导性的是否式问句控制话题并限制证人的回答内容。一方面,证人应该保持证言前后一致（形式衔接、内容连贯）;另一方面,证人要响应辩护律师的问题,且回答应与律师的提问相关联。法庭这一特定的语境限制了参与者的发言形式和内容,从而避免陈述权力的滥用,提高公正判决案件的可能性。本文在拉波夫叙事理论的框架中分析语篇的衔接手段;在关联理论明示-推理交际模式的基础上,分析语义关联、话题关联和语境关联对语篇衔接的促进作用。 本文的结论是:证言证词的关联性和衔接性有助于增强叙事话语的说服力。
