公司社会责任的法学思辨

【摘要】：我国公司法规定公司应当承担社会责任,但实践中对于公司社会责任理论的研究还比较薄弱。要明确公司法总则中公司社会责任条款的原则、地位和内涵,充分保障利益相关者参与公司治理,完善公司社会责任诉讼救济,以期在我国立法和法律实践中对公司社会责任进行系统建构。
[Abstract]:The company law of our country stipulates that the company should bear the social responsibility, but the research on the theory of corporate social responsibility is relatively weak in practice. It is necessary to make clear the principle, status and connotation of the corporate social responsibility clause in the general principles of company law, to fully ensure the participation of stakeholders in corporate governance, and to improve the relief of corporate social responsibility litigation. In order to construct the corporate social responsibility systematically in the legislation and legal practice of our country.
