民法强行性规范之效力分析——兼以公司法为视角

【摘要】：强行性规范直接决定着法律行为的效力,其重要性不言而喻。以公司法为视角分析强行性规范的效力,首先理清强行性规范的概念,并指出辨别强行性规范的方法,并论述违反强行性规范的法律行为的效力。
[Abstract]:Mandatory norms directly determine the effectiveness of legal acts, its importance is self-evident. This paper analyzes the validity of mandatory norms from the angle of company law, first of all, clarifies the concept of mandatory norms, points out the methods of distinguishing forcible norms, and discusses the effectiveness of legal acts that violate forcible norms.
