法人档案行为的自律及政府的监督

【摘要】：正规范企业法人行为,对深化经济体制改革,增强企业活力,有着十分重要的作用。根据《全民所有制工业企业法》、《公司法》等法律规定,企业法人对企业负有全权全责,以利于企业建立统一的、强有力的、高效率的生产指挥和经营管理系统。法律赋予企业法人的职权并不意味着企业法人可以为所欲为,独断专行。企业法人首先要对法律负责,在国家法律法规的允许下自主管理。档案法规是国家法规的组成部分,是公民档案行为的规范,企业法人的档案行为更须规范化。过去,档案行政管理部门抓档案工作,只抓各单位档案部门,不抓企业法人,因而许多档案法规中早已明确规定的条款得不到贯彻执行,形成无权的人泛泛而谈,有权的人我行我素的局面。笔者
[Abstract]:Standardizing the behavior of enterprise legal person plays a very important role in deepening the reform of economic system and enhancing the vitality of enterprises. According to the Law on Industrial Enterprises under the ownership of the whole people, the Company Law and other laws, the enterprise legal person has full responsibility for the enterprise, in order to facilitate the establishment of a unified, powerful and efficient production command and management system. The power granted by law does not mean that an enterprise legal person can do whatever it wants and do it arbitrarily. The enterprise legal person should be responsible for the law first and manage independently with the permission of the national laws and regulations. Archives law is a part of national laws and regulations, and it is the norm of citizens' archives behavior, and the archives behavior of enterprise legal person must be standardized. In the past, the archival administration departments focused on archives work, only on archives departments of various units, and not on enterprise legal persons. As a result, the provisions of many archives laws and regulations that had already been clearly stipulated were not carried out, and people who had no right to do so were generally talked about.
