新《环保法》公众参与规定的理解与适用

【摘要】：环境权益是我国环境保护公众参与的权利基础,2014年新《环保法》对环境保护公众参与的规定取得突破进展,本文结合新《环保法》对环保公众参与的最新规定,分析了当前我国环境保护公众参与的主要领域,公众参与的基本权能与相关义务,指出了我国环境保护公众参与的现存问题,并提出了公众参与的实现保障。
[Abstract]:Environmental rights and interests are the right basis of public participation in environmental protection in China. In 2014, the new "Environmental Protection Law" has made a breakthrough in the provisions of public participation in environmental protection. Combined with the latest regulations of the new Environmental Protection Law, this paper analyzes the main fields of public participation in environmental protection, the basic competence and related obligations of public participation in environmental protection in China. This paper points out the existing problems of public participation in environmental protection in China, and puts forward the guarantee of public participation.
