山西可再生能源开发利用的法律问题研究

【摘要】： 提高能源利用效率和发展可再生能源已成为全球能源可持续发展的两个车轮。近年来,伴随着经济快速发展对能源的需求,传统的煤炭、石油等能源开采利用越来越受到资源、环境和运输等条件的限制,能源是否可持续发展关系到社会和经济能否健康稳定地发展,面对经济社会发展和环境保护的双重任务,重新构建合理的能源结构,加强对可再生能源的立法建设是十分必要的。我国的可再生能源的立法和实施才刚刚起步,《中华人民共和国可再生能源法》的通过对促进可再生能源的开发利用、增加能源供应、改善能源结构、保障能源安全、保护环境、实现我国经济社会的可持续发展,具有十分重大的意义;但是由于我国可再生能源的开发利用还存在许多障碍和自身的诸多问题,并且对开发利用可再生能源过程中的法律体系还不完善,因此为兼顾各地不同的情况,需要国家及各地方及时制定各项配套的法规、规章及标准,进一步构建有我国特色的可再生能源法律体系,即一个稳定的、具有实际内容和效力的,以基本法与专项立法相结合,以全国人大立法和国务院行政法规为主、部门规章和地方性法规为辅的法律体系,它是以可再生能源基本法为核心,专项法完备的,有多层次,门类齐全的可再生能源法组成的有机联系的统一整体。本研究从国外、国内及地方开发利用可再生能源的法律问题入手,通过借鉴国外成熟的相关法律,立足山西,提出完善我省可再生能源开发利用的法规的建议,如:构建山西可再生能源产业促进法;构建山西可再生能源科技促进法;构建山西可再生能源的其它配套法规规章;细化或补充配套法律制度;协调相关政策法律制度之间的关系;评估政策法律的实施情况;加强可再生能源政策体系建设,强化行业管理等。为建立我们山西良性循环的资源市场,促进人与自然和谐共处贡献自己的一份力量。
[Abstract]:Improving energy efficiency and developing renewable energy have become the two wheels of global energy sustainable development. In recent years, with the rapid economic development of energy demand, traditional coal, oil and other energy resources are increasingly used. With the restriction of environment and transportation, the sustainable development of energy is related to the healthy and stable development of society and economy. In the face of the dual task of economic and social development and environmental protection, the rational energy structure should be reconstructed. It is necessary to strengthen legislation on renewable energy. The legislation and implementation of renewable energy in China has only just begun. The adoption of the Renewable Energy Law of the people's Republic of China promotes the development and utilization of renewable energy, increases the supply of energy, improves the energy structure, and guarantees energy security. It is of great significance to protect the environment and realize the sustainable development of our country's economy and society. However, there are still many obstacles and problems in the development and utilization of renewable energy in our country. And the legal system in the process of developing and utilizing renewable energy is not perfect. Therefore, in order to take into account the different conditions in various places, it is necessary for the state and all localities to formulate various supporting laws, regulations and standards in a timely manner. To further build a legal system of renewable energy with Chinese characteristics, that is, a stable, practical and effective legal system, with the combination of the basic Law and special legislation, the NPC legislation and the administrative regulations of the State Council, The department regulations and the local laws and regulations are supplemented by the legal system. It is a unified whole with the basic law of renewable energy as the core, the special law is complete, there are many levels and categories of renewable energy laws. This study starts with the legal problems in the development and utilization of renewable energy in foreign, domestic and local areas, and puts forward some suggestions on how to perfect the laws and regulations of renewable energy development and utilization in our province by referring to the relevant laws and regulations of foreign countries and based on Shanxi Province. For example: to construct the law of promoting renewable energy industry in Shanxi; to construct the law of promoting science and technology of renewable energy in Shanxi; to construct other supporting laws and regulations of renewable energy in Shanxi; to refine or supplement the supporting legal system; To coordinate the relationship between relevant policy and legal systems; to assess the implementation of policies and laws; to strengthen the construction of renewable energy policy systems; and to strengthen industry management. Promote the harmonious coexistence of man and nature to contribute to their own strength.
