温室气体排放权交易法律制度研究

【摘要】：全球气候变暖日益威胁人类的生存与发展,自20世纪80年代起,世界各国为此开展了广泛的气候合作,温室气体排放权交易应运而生。作为世界上最大的发展中国家,中国通过积极参与清洁发展机制交易,但国内的排放权交易市场才刚刚起步,法律制度建设任重道远。在构建我国温室气体排放权交易制度的过程中,我们应学习国际排放权市场的制度设置和运营管理经验,建立具有中国特色的的温室气体排放权交易市场。本文依照以下逻辑顺序逐步展开论述。首先,本文对温室气体排放权交易的内涵、理论基础以及交易原理进行概括、梳理,并简要介绍了美国、欧盟等几个比较成熟的排放权交易市场。然后,从温室气体排放权交易的主体、客体,排放权指标分配制度,监管核证制度几个方面,分析温室气体排放权市场的相关制度设计。最后,本文分析国内温室气体排放权交易的现状和存在的缺陷,提出了一些构建我国温室气体排放权交易法律制度的初步设想,具体包括构建温室气体排放权交易制度的基本原则,如何设置排放权交易的主体、客体,怎样分阶段制定排放权指标分配制度,如何完善监管制度。
[Abstract]:Global warming is increasingly threatening the survival and development of mankind. Since 1980s, various countries in the world have carried out extensive climate cooperation, and greenhouse gas emissions trading has emerged as the times require. As the largest developing country in the world, China has actively participated in the clean development mechanism (CDM) trading, but the domestic emissions trading market is just beginning, and the legal system has a long way to go. In the process of establishing China's greenhouse gas emissions trading system, We should learn from the experience of system setting and operation management in the international emission rights market and establish a greenhouse gas emission rights trading market with Chinese characteristics. Firstly, this paper generalizes the connotation, theoretical basis and trading principle of greenhouse gas emissions trading, and briefly introduces the United States. The European Union and other relatively mature emission trading markets. Then, from the aspects of the subject, the object, the allocation system of emission rights indicators, the regulatory and certification system of greenhouse gas emission rights trading, Finally, this paper analyzes the current situation and defects of greenhouse gas emission right trading in China, and puts forward some tentative ideas to construct the legal system of greenhouse gas emission right trading in China. It includes the basic principles of establishing the trading system of greenhouse gas emission rights, how to set up the subject and object of emission right trading, how to formulate the distribution system of emission right index in stages, and how to perfect the supervision system.
