论我国环境纠纷解决机制的完善

【摘要】： 多年来,由于学界努力,环境纠纷解决机制理论基本成熟。纠纷解决机制以环境权为基础,以谈判、调解、仲裁、诉讼基本法理为支撑,通过特定程序和方式,以实现环境正义为目标,解决环境纠纷和冲突,恢复社会平衡和秩序。事实上,发达国家早已形成有各自特点的环境纠纷解决机制,美国环境公益诉讼较为突出,日本行政处理有特色。对照环境纠纷解决机制基本理论内在要求和发达国家模式,我国缺乏专门的环境纠纷处理立法、开展环境诉讼艰难、行政处理不规范等存在诸多问题,因此,需要从确立环境权、确立环境公益诉讼制度、完善ADR制度等多方面予以完善,从根本上重新配置权利和义务,重新设定法律程序,构筑多元化的环境纠纷解决机制。
[Abstract]:Over the years, due to academic efforts, the theory of environmental dispute resolution mechanism has basically matured. The dispute resolution mechanism is based on environmental rights, supported by basic legal principles of negotiation, mediation, arbitration and litigation, and through specific procedures and methods. The goal is to achieve environmental justice, to resolve environmental disputes and conflicts, and to restore social balance and order. In fact, developed countries have already formed their own environmental dispute resolution mechanisms, and environmental public interest litigation in the United States is more prominent. Compared with the internal requirements of the basic theory of environmental dispute resolution mechanism and the model of developed countries, there are many problems in our country, such as the lack of special legislation on environmental dispute settlement, the difficulty of carrying out environmental litigation, and the non-standard administrative treatment. Therefore, it is necessary to perfect the environmental rights, establish the environmental public interest litigation system, perfect the ADR system and so on, fundamentally reconfigure the rights and obligations, re-establish the legal procedures, and construct a diversified environmental dispute resolution mechanism.
