促进可再生能源发展法律机制研究

【摘要】： 化石燃料能源含有大量的碳成分,排放出的温室气体进入大气层,致使全球温度升高,同时经过几百年的消耗,现有的化石燃料资源已濒临枯竭。环境恶化和能源枯竭的双重压力,迫使人类必须采用更清洁、持久和稳定的能源,可再生能源正是在这种背景下进入人类的视野,被各国广泛发展和采用。我国拥有丰富的可再生能源资源,发展可再生能源是实现国民经济可持续发展的重要保障。能源是国家生存和发展的血液,目前各国大力发展可再生能源,我国也将可再生能源列入“十一五规划”重点发展领域。但我国与国外发达国家相比,可再生能源进展缓慢,一方面是受制于我国经济水平不高和科研的落后,另一方面则是我国可再生能源法律法规的不完善。有必要采取更强有力的措施激励可再生能源的发展,确保我国能源供应多元化,从而使我国的发展不再受制于人。从这一层面上看,研究可再生能源具有紧迫的现实意义。本文将采用实证分析方法、数据分析方法等多种研究方法,针对可再生能源发展在我国面临的各种困难和阻碍,借鉴国外可再生能源法律法规的优点和成功经验,提出建议措施,从而弥补我国可再生能源法律法规的不足,完善我国可再生能源法律法规体系。本文第一部分将介绍可再生能源在我国的总体状况。包括可再生能源资源的存储、分布、利用,以及我国已制定的与发展可再生能源相关的一系列法律法规,并对我国可再生能源法律法规进行评析。第二部分将分析发展可再生能源在我国所面临的各种困境。包括可再生能源自身存在的不足,包括市场机制、科研水平、法律法规的执行等方面;以及外部环境的限制,如社会缺乏对可再生能源信息的了解和传统能源利益集团的阻碍。第三部分将介绍国外发展可再生能源法律法规的概况。通过对世界可再生能源发展较好的国家,如美国、欧盟各国、日本等相关的可再生能源法律法规的介绍,分析其法律法规中的优点和成功措施,为完善我国可再生能源法律法规提供借鉴。第四部分主要针对我国可再生能源法律法规过于原则和空洞,缺乏具体激励措施和实施细则的不足之处,本文作者试图将第三部分中总结出的的国外成功的激励措施,作为补充和完善我国可再生能源法律法规体系的参考,同时解决第二部分提到的发展可再生能源法律法规在我国所面临的诸多困难。
[Abstract]:Fossil fuel energy contains a lot of carbon and emissions of greenhouse gases into the atmosphere, causing global temperatures to rise, and over hundreds of years of consumption, Existing fossil fuel resources are on the verge of depletion. The dual pressures of environmental degradation and energy depletion force mankind to adopt cleaner, durable and stable sources of energy, and it is in this context that renewable energy has entered the human eye, China has abundant renewable energy resources, and the development of renewable energy is an important guarantee to realize the sustainable development of national economy. Energy is the blood of the survival and development of our country. At present, all countries are vigorously developing renewable energy, and China has also included renewable energy in the key areas of development in the 11th Five-Year Plan. However, compared with the developed countries abroad, the progress of renewable energy in China is slow. On the one hand, it is restricted by the low economic level and backward scientific research in our country, on the other hand, the laws and regulations of renewable energy in our country are not perfect. It is necessary to take more powerful measures to stimulate the development of renewable energy. In order to ensure the diversification of energy supply in China, so that the development of our country is no longer controlled by others. From this level, it is of urgent practical significance to study renewable energy. In view of the difficulties and obstacles faced by the development of renewable energy in China, and drawing on the advantages and successful experiences of foreign laws and regulations on renewable energy, the paper puts forward some suggestions. In order to make up for the shortage of laws and regulations of renewable energy in our country, perfect the system of laws and regulations of renewable energy in our country. The first part of this paper will introduce the general situation of renewable energy in China, including the storage, distribution, utilization of renewable energy resources, and a series of laws and regulations related to the development of renewable energy. And the laws and regulations of renewable energy in China are evaluated. The second part will analyze the difficulties faced by the development of renewable energy in China, including the shortcomings of renewable energy itself, including market mechanism, scientific research level, enforcement of laws and regulations, as well as the restrictions of external environment. Such as the lack of social understanding of renewable energy information and traditional energy interests. The third part will introduce the laws and regulations about the development of renewable energy in other countries, such as the United States, the European Union, Japan and other countries in the world. The advantages and successful measures of its laws and regulations are analyzed to provide reference for perfecting the laws and regulations of renewable energy in China. In part 4th, the author tries to sum up the foreign successful incentive measures in the third part because the laws and regulations of renewable energy in our country are too principle and empty, and lack of specific incentive measures and implementation rules. As a reference to supplement and perfect the laws and regulations system of renewable energy in our country, at the same time to solve the difficulties of developing the laws and regulations of renewable energy mentioned in the second part in our country.
