关于拆船污染环境的法律问题研究

【摘要】： 中国自上世纪80年代以来就一直位居世界拆船量的前3名。目前全国30余家拆船厂高度集中在珠江三角洲及长江三角洲一带,拆解能力占全国的90%。由于中国政府非常重视从制度层面上规范拆船行业的管理,并积极督促企业增加拆船防污设施的投入,加大了对拆船业人员的培训力度,中国拆船业的环保和安全工作也走在世界前列。但是,由于中国的拆船业本身存在着各种各样的问题,以及主管机关对拆船业的行政监管和行政执法也存在着种种问题,致使这一本是资源再循环、减少污染、保护水域环境的产业起到了反作用,给环境造成了污染,也损害了人体健康。为了使拆船业能够健康有序地发展下去,成为真正可持续发展的环保产业,作者从法律的角度,运用分析比较以及理论联系实际的方法,对拆船业自身存在的问题以及主管机关存在的问题进行了分析研究,希望能对拆船业的发展带来裨益。本文首先从拆船业的过去、现状以及发展前景入手,对拆船业进行初步了解,分析了拆船业存在的问题,也了解到国内外对拆船业的重视;其次从法律角度深入了解我国对拆船主体的法律规定,包括资质、审批以及法律责任等方面;再次重点分析了当前我国在对拆船业进行监管中存在的弊端,并结合相关法律法规论证了拆船主管机关在管理体制和行政执法方面的不足;最后,结合实际情况,提出了几点建议,即通过完善拆船管理法规体系,制定地方性法律法规;加强监督,建立规范标准的管理程序;完善拆船污染环境的管理体制;加强相关部门的行政执法等措施,在保护环境的同时,可持续地发展拆船行业。
[Abstract]:Since -20s, China has been among the top three shipwrecks in the world. At present, more than 30 shipbreaking yards in China are highly concentrated in the Pearl River Delta and the Yangtze River Delta. Dismantling capacity accounts for 90% of the nation's total. Since the Chinese government attaches great importance to standardizing the management of shipbreaking industries at the institutional level, and actively urges enterprises to increase investment in anti-pollution facilities for shipbreaking, it has increased the training of shipbreaking personnel. The environmental protection and safety work of China's shipbreaking industry is also in the forefront of the world. However, because of the various problems in China's shipbreaking industry itself, as well as the administrative supervision and enforcement of the shipbreaking industry by the competent authorities, there are also various problems. As a result of this recycling of resources, reducing pollution and protecting the water environment, the industry has played a counterproductive role, causing pollution to the environment and harming human health, in order to enable the shipbreaking industry to develop in a healthy and orderly manner. As a truly sustainable development of environmental protection industry, the author analyzes and studies the problems existing in shipbreaking industry and the competent authorities from the perspective of law, using the methods of analysis and comparison and the combination of theory and practice. I hope it will benefit the development of shipbreaking industry. This paper starts with the past, present situation and development prospect of shipbreaking industry, analyzes the existing problems of shipbreaking industry, and also understands the importance of shipbreaking industry at home and abroad. Secondly, from the legal point of view, deeply understand the legal provisions of the main body of ship demolition, including qualification, examination and approval, and legal responsibility. Again, it focuses on the analysis of the defects existing in the supervision of the shipbreaking industry in our country at present. Combined with the relevant laws and regulations to demonstrate the shipbreaking authority in the management system and administrative law enforcement deficiencies; finally, combined with the actual situation, put forward several suggestions, that is, through the improvement of shipbreaking management laws and regulations system, the formulation of local laws and regulations; Strengthening supervision, establishing standardized management procedures, perfecting the management system of pollution environment from shipbreaking, strengthening the administrative law enforcement of relevant departments, and developing the shipbreaking industry sustainably while protecting the environment.
