土地资源保护与土地法相关制度研究

【摘要】： 土地资源是人类最重要的财富之一,随着世界经济的发展与人口的增长,土地资源的稀缺性日益成为全世界关注的焦点,而对土地资源的法律保护及对土地法律关系的法律调整也成为各国立法机关及法学家越来越重视的问题之一。纵观我国以往对于土地资源保护的立法与研究,将土地资源作为一项财产,将土地资源相关法律制度作为民事法律制度进行研究的论著较多,而本文试图将土地资源真正作为一种关系到国家安全的亟待严格保护的重要资源,从综合立法保护的角度提出见解和建议。本文第一章对土地资源的基本属性与特征进行了分析,其中土地资源的特征是后文关于土地资源立法和政策等的重要基础。并且对各相关学科,尤其是法学角度的土地资源的定义进行综述,并分析了我国立法体系中相应的漏洞;第二章是关于我国土地相关立法历史沿革的综述;第三章首先分析了我国土地相关立法的体系,并以土地管理法为核心,对我国土地资源保护与管理的各项制度进行了具体分析,并提出问题;第四章则是综合相关资料和笔者的见解,对我国土地资源保护提出了立法建议。
[Abstract]:Land resource is one of the most important wealth of human being. With the development of world economy and the increase of population, the scarcity of land resource has become the focus of attention all over the world. The legal protection of land resources and the legal adjustment of land legal relations have become one of the more and more important issues in the legislatures and jurists of various countries. There are many studies on land resources as a property and related legal systems of land resources as civil legal systems. However, this paper attempts to take land resources as a kind of important resources which need to be strictly protected in relation to national security. Put forward opinions and suggestions from the angle of comprehensive legislative protection. The first chapter of this paper analyzes the basic attributes and characteristics of land resources, in which the characteristics of land resources are the important basis of the legislation and policy on land resources in the following articles. In particular, the definition of land resources from the perspective of law is summarized, and the corresponding loopholes in the legislative system of our country are analyzed. The third chapter first analyzes the system of land related legislation in our country, and takes the land management law as the core, carries on the concrete analysis to our country land resources protection and the management system, and raises the question; Chapter 4th synthesizes the relevant data and the author's opinion, and puts forward the legislative suggestion to our country's land resources protection.
