我国电力监管法律制度研究

【摘要】： 电力产业是关系到国计民生的基础产业。电力投资巨大,规模经济特征显著,长期被认为是自然垄断产业。在电力工业改革之前,大部分国家电力市场都是发、输、配、售垂直一体化的结构模式,这种市场结构垄断规模过大,经营效益不佳,政府对电力产业监管失灵导致效率低下。20世纪80年代以来,全球除非洲及亚洲的少数国家外,都进行了电力工业市场化改革。改革的核心内容是打破垄断、引入竞争,重点是改革政府对电力产业的管理体制和方式,建立新的符合市场化需要的政府监管体制。国外电力市场化改革成功的国家都建立并不断完善电力监管制度,在电价与激励性监管、对垄断行为的监管、市场准入监管、监管程序等方面有着较为成熟的经验。我国电力工业市场化改革刚刚开始,相关法律制度尚不健全和完善。本文就我国电力监管法律制度问题进行了研究。全文共分为五章。第一章从电力监管的相关概念引出电力监管制度,介绍了该制度的历史沿革和相关法律问题。第二章阐述了监管制度的理论基础,探索了政府该如何把握在电力行业加强监管和深化市场化改革之间“度”的问题,论证了我国加强电力监管的必要性,试论了电力监管可能面临的风险。第三章从比较法的角度介绍了美国、英国、法国等国的电力改革历程和电力监管制度,将国外的监管模式分为低度监管、中度监管、高度监管三种模式,总结成熟的电力监管制度所应具备的要素,以及对完善我们电力监管制度的启示。第四章介绍了我国电力体制改革历程,阐述我国电力监管法律制度的现状,分析其存在的问题。第五章从我国电力产业的立法体系出发,提出完善监管立法和原则的建议,从监管主体的设置、监管主体的独立性问题、监管职权配置、监管限度、监管程序、法律责任和权力救济等角度构筑我国电力监管制度的具体完善方案。
[Abstract]:The electric power industry is the basic industry related to the national economy and the people's livelihood. The power investment is huge, the scale economy characteristic is remarkable, the long-term is considered to be the natural monopoly industry. The vertical integration of sales structure, this kind of market structure monopoly scale is too big, the operation benefit is not good, the government to the electric power industry regulation failure causes inefficiency. Since 80s, the whole world except a few countries in Africa and Asia, The core content of the reform is to break the monopoly, introduce competition, and focus on the reform of the government's management system and mode of the electric power industry. Establishing a new government supervision system that meets the needs of marketization. Countries that have successfully reformed the electricity market in foreign countries have established and continuously improved the electric power supervision system, in terms of electricity price and incentive supervision, monopoly behavior supervision, market access supervision, China's electric power industry has just started the market-oriented reform, and the relevant legal system is not perfect and perfect. This paper studies the legal system of China's electric power supervision. The full text is divided into five chapters. The first chapter introduces the power supervision system from the relevant concepts of electricity supervision, introduces the historical evolution of the system and related legal issues. Chapter two describes the theoretical basis of the supervision system. This paper probes into how the government should grasp the problem of "degree" between strengthening supervision and deepening market-oriented reform in the electric power industry, and proves the necessity of strengthening the supervision of electric power in our country. The third chapter introduces the process of electric power reform in the United States, Britain, France and other countries from the perspective of comparative law, and divides the foreign regulatory models into low supervision and moderate supervision. Three modes of high supervision, including the elements of the mature electric power supervision system, and the enlightenment to the perfection of our power supervision system. Chapter 4th introduces the reform course of the electric power system in our country. This paper expounds the present situation of the legal system of electric power supervision in China, and analyzes its existing problems. Chapter 5th puts forward some suggestions for perfecting the legislation and principles of supervision and regulations from the legislative system of China's electric power industry, and sets up the main body of supervision. From the aspects of the independence of the main body of supervision, the allocation of supervision authority, the limitation of supervision, the procedure of supervision, the legal responsibility and the relief of power, the concrete perfection scheme of our country's electric power supervision system is constructed.
