西北干旱缺水地区雨水集蓄的工程保护方面存在的法律问题分析

【摘要】： 2006年以来,通过以问卷、访谈等形式在甘肃部分地区开展的一系列对西北干旱缺水地区雨水集蓄现状的实地调研和分析,我们发现西北地区雨水集蓄工程建设在取得长足进步的同时,也存在着诸多法律问题。雨水集蓄工程在规模化发展的同时,近年来也逐渐受到土地、农业基础设施、劳动力等生产要素相互脱节的困扰,雨水集蓄基础设施也因缺少相关法律法规的支持而出现管护不力等现象。本文试就这些问题进行分析、梳理和探讨,寻找权威治理与专业化治理、民主治理与科学化治理相结合的途径来解决西北干旱缺水地区雨水集蓄利用的法律保障制度,从雨水集蓄工程中的建筑材料、技术规范与工程实体等几个方面探讨在西北地区雨水集蓄工程建设和保护中应当引起关注和着手解决的若干现实问题,以便为加强促进西北干旱缺水地区雨水集蓄工程的建设和发展提供一些有益的思考。本文先从西北干旱缺水地区水资源概况论起,阐述了这一地区实施雨水集蓄工程的背景和意义;接下来从雨水集蓄工程的组成部分入手,论述了西北干旱缺水地区雨水集蓄工程的发展现状,并分别从雨水集蓄工程保护中的建筑材料、技术规范、工程实体三个方面进行问题分析;随之就上述三个方面提出法律保护层面上的立法建议,并着重从权责分离和完善农业保险的角度给予了理论阐述。
[Abstract]:Since 2006, through a series of on-the-spot investigation and analysis on Rain Water's current situation of gathering and storage in arid and water-deficient areas of northwest China in some parts of Gansu Province by means of questionnaires and interviews, We found that while the construction of Rain Water's gathering and storage project in Northwest China has made considerable progress, there are also many legal problems. With the large-scale development of Rain Water's collective storage project, in recent years, it has also gradually been subjected to land and agricultural infrastructure. The factors of production, such as labor force, are disjointed from each other, and Rain Water's infrastructure of gathering and storing has also appeared the phenomenon of poor management and protection due to the lack of support from relevant laws and regulations. This paper tries to analyze, comb and discuss these problems. To find a way to combine authoritative governance with professional governance, democratic governance and scientific governance to solve the legal guarantee system of Rain Water's collective utilization in arid and water-deficient areas in northwest China, and from the architectural materials in the Rain Water collective storage project, This paper discusses some practical problems that should be paid attention to and solved in the construction and protection of Rain Water's collective storage project in Northwest China from several aspects, such as technical specifications and engineering entities. In order to strengthen the construction and development of Rain Water gathering and storage project in arid and water shortage areas of northwest China, some useful thoughts are provided. This paper begins with the general situation of water resources in arid and water shortage areas in northwest China, and expounds the background and significance of the implementation of Rain Water's collective storage project in this area. This paper discusses the present situation of Rain Water gathering and storage project in arid and water shortage area of northwest China, and analyzes the problems from three aspects: building material, technical specification and engineering entity. Then it puts forward the legislative suggestions on the above three aspects of legal protection, and focuses on the separation of power and responsibility and the improvement of agricultural insurance.
