防止船舶造成渤海海域环境污染的法律手段研究

【摘要】： 本文针对渤海海域日趋严重的污染形势,以及船舶对渤海海域海洋环境的重大污染威胁,研究提出了防止船舶造成渤海海域海洋环境污染可采取的法律手段。本文研究的目标是,分析我国现行的防止船舶造成海洋环境污染的法律、法规不适应渤海海域环境保护要求的成因,并提出防止船舶造成渤海海域环境污染可采取的有效法律手段。研究的主要内容包括以下几个方面:(一)渤海海域的基本情况、污染现状及其对我国经济社会的重要影响,以及我国为解决渤海海域海洋环境污染问题所做的工作、取得的效果、存在的问题;(二)我国现行的船舶防污染法律、法规体系,及其与渤海海域环境保护工作不相适应的状况;(三)我国目前有关防止船舶污染渤海环境的立法现状及其存在的主要问题;(四)防止船舶造成渤海海域环境污染可采取的法律手段研究。文章首先对渤海海域海洋环境污染现状及其对我国社会、经济的重要影响进行了分析,阐述了渤海海域环境保护的重要意义和紧迫性。在此基础上,从法律层面深入研究分析了我国现行的船舶防污染法律、法规不适应渤海海域环境保护要求的具体表现,并对其原因进行了分析。研究提出了防止船舶造成渤海海域海洋环境污染可采取的法律手段,即通过国际海事组织(IMO)将渤海海域指定为特别敏感海域(PSSAs),或将渤海海域作为海洋特别保护区,通过国内立法程序制定有针对性的法律、行政法规或部门规章。在以上研究分析的基础上,对两种法律手段分别进行了详细阐述。其一,全面细致地论述了特别敏感海域的国际法地位,以及将渤海海域指定为特别敏感海域的必要性和可行性,并论述了将渤海海域指定为特别敏感海域的法律程序,为国家有关部门提供决策参考依据。其二,深入论述了将渤海海域作为海洋特别保护区的国内立法应解决的主要问题。包括国内立法的适用范围及立法层次、国内立法应解决的主要问题等等。
[Abstract]:In view of the increasingly serious pollution situation in the Bohai Sea area and the serious pollution threat from ships to the marine environment in the Bohai Sea area, this paper puts forward the legal means to prevent the marine environmental pollution caused by ships in the Bohai Sea area. The purpose of this paper is to analyze the causes of the current laws and regulations that prevent the marine environment pollution caused by ships in China, which are not suitable for the environmental protection requirements of the Bohai Sea area. The main contents of the study include the following aspects: (1) the basic situation of Bohai Sea area, the status quo of pollution and its important impact on China's economy and society. As well as the work done by our country to solve the problem of marine environmental pollution in the Bohai Sea area, the results obtained and the problems existing (2) the current marine pollution prevention laws and regulations system of our country, Status quo of China's current legislation on the Prevention of pollution of the Bohai Sea Environment by ships and its main problems (4) Prevention of Environmental pollution caused by ships in the Bohai Sea area. Possible legal means for study. This paper first analyzes the present situation of marine environmental pollution in Bohai Sea area and its important influence on our society and economy, and expounds the significance and urgency of the environmental protection in Bohai Sea area. From the legal level, this paper deeply studies and analyzes the specific performance of the current ship pollution prevention laws and regulations in China, which do not meet the requirements of environmental protection in the Bohai Sea area. The reasons are analyzed, and the legal means to prevent the marine environmental pollution caused by ships in Bohai Sea are put forward. That is to say, the Bohai Sea area is designated as a special sensitive sea area through the International Maritime Organization (IMO), or the Bohai Sea Sea area is regarded as a special marine protection area, and the relevant laws, administrative regulations or departmental regulations are formulated through domestic legislative procedures. On the basis of the above research and analysis, the two kinds of legal means are elaborated in detail. First, the international law status of particularly sensitive sea areas is comprehensively and meticulously discussed. The necessity and feasibility of designating the Bohai Sea area as a particularly sensitive sea area are also discussed. The legal procedure of designating the Bohai Sea Sea area as a particularly sensitive sea area is discussed, which provides a reference basis for the relevant departments of the state to make a decision. The main problems that should be solved in the domestic legislation of the Bohai Sea area as a special marine protection area are discussed, including the applicable scope and the legislative level of the domestic legislation, the main problems to be solved by the domestic legislation, and so on.
