【摘要】：作为全面推进集体林权制度改革的一项重要任务,完善林权流转法律制度,具有重要的理论和现实意义。采用历史分析的研究方法,将建国以来林权流转法律制度划分为三个阶段,依次展开梳理和检讨：立法理念呈现出从禁止到限制再到鼓励的转变趋向,现行林权流转法律制度在总体上处于一种残缺不全、复杂混乱、零散无序、欠缺理性的状态。在明晰林权他物权属性的基础上,从主体、客体、方式、程序等角度界定了林权流转的基本含义。现行林权流转原则在法律权威性、体系化、合理性、完整性等方面存在局限,完善的基本思路为：考虑林权流转法律制度的基本价值取向、法律渊源和具体立法技术,综合利用林权流转原则的各种分类理论,构建一个全面系统、层级分明的原则体系。在系统梳理检讨现行制度的基础上,提出林权流转具体制度的完善构想：林权流转的内容包括商品林和一定范围公益林上的林地使用权、林木经营权和森林环境经营权；统一规定林权流转具体方式的种类,在林权流转范畴内专门界定各种具体方式的含义；构建由启动环节、审批环节和公示环节构成的基本流程,具体流程依据林权流转具体法律效果的不同设置差异性的程序要求,合理确定违反具体流程各项程序性要求的法律后果。
[Abstract]:As an important task to promote the reform of collective forest tenure system, it is of great theoretical and practical significance to perfect the legal system of forest property right circulation. This paper divides the legal system of forest property right circulation into three stages since the founding of the people's Republic of China, and then starts to sort out and review it in turn: the legislative idea shows a trend of changing from prohibition to restriction to encouragement, and the current legal system of forest property right circulation is in a kind of incomplete and incomplete in general. Complex chaos, scattered disorder, lack of rational state. On the basis of clarifying the property attribute of other real right of forest right, this paper defines the basic meaning of forest right circulation from the angles of subject, object, mode, procedure, etc. There are limitations in systematization, rationality and integrity. The basic ideas of perfection are as follows: considering the basic value orientation of the legal system of forest property right circulation, the legal origin and the specific legislative technology, and synthetically utilizing the various classification theories of the forest right circulation principle, Build a comprehensive and hierarchical system of principles. On the basis of a systematic review of the current system, Put forward the perfect conception of the concrete system of forest right circulation: the content of forest right circulation includes the use right of forest land on commercial forest and certain range of public welfare forest, the right of forest management and the right of management of forest environment; In the category of forest property right circulation, we define the meaning of various specific ways; construct the basic process composed of startup link, examination and approval link and public link; the concrete process is based on the procedural requirements of different setting difference of the specific legal effect of forest property right circulation. Reasonably determine the legal consequences of violating the procedural requirements of specific procedures.
