西部地区可再生能源的立法保障研究

【摘要】：20世纪70年代以来,由于石油危机和环境问题凸现,世界各国开始重视可再生能源的开发利用,通过立法和采取各种政策措施支持发展可再生能源,使可再生能源产业化水平不断提高,规模不断扩大。可再生能源以其清洁、无污染、可永续利用等特点已成为实现能源多样化、应对气候变化和实现可持续发展的重要替代能源。近年来,我国能源消费急剧增长,供需矛盾日益突出,并且,以煤为主的传统能源结构造成环境污染和生态破坏,能源问题与环境问题已经成为中国经济社会可持续发展的最大制约。我国出台的能源发展“十一五”规划、可再生能源“十一五”规划、2000——2015年新能源和可再生能源产业发展规划等规划文件指明了我国解决能源问题、改变生态环境的途径是大力发展可再生能源。我国西部地区地处我国的西部,生态环境脆弱,经济发展落后,特别是贫困地区及少数民族地区仍然依靠传统的生物质能生活,不仅能源效率低,而且造成环境污染,生态破坏。然而,西部地区却有着极其丰富的可再生能源资源,这些能源清洁、无污染,大力促进西部地区因地制宜的开发利用太阳能、生物质能等清洁的可再生能源,不仅能解决西部地区的能源紧缺问题,而且能减少环境破坏,还能拉动经济的发展。可谓,一举多得。并且,促进西部地区开发利用可再生能源是我国实施节能减排,建设资源节约型、环境友好型社会的客观要求,是我国进行生态文明建设及新农村建设的必然选择。强制性的法律手段是促进可再生能源产业蓬勃发展的根本保障,所以要促进西部地区可再生能源的开发利用,就要从法制方面加以完善。因此,本选题具有重要的现实意义。目前,我国对于可再生能源立法方面的研究较多,但是对于西部地区开发利用可再生能源的法律法规研究较少。本文立足于我国西部,通过分析对比国内外的相关法律规定,结合我国及西部地区在可再生能源立法上存在的问题,提出一些促进我国西部地区可再生能源开发利用的建议,以期为西部地区可再生能源法律法规的进一步完善贡献微薄之力。
[Abstract]:Since 1970s, due to the oil crisis and environmental problems, countries around the world have begun to attach importance to the development and utilization of renewable energy, through legislation and various policy measures to support the development of renewable energy. The industrialization level and scale of renewable energy have been continuously improved and expanded. Renewable energy has become a source of energy diversification with its characteristics of cleanliness, pollution-free and sustainable utilization. In recent years, China's energy consumption has increased sharply, the contradiction between supply and demand has become increasingly prominent, and the traditional coal-based energy structure has caused environmental pollution and ecological damage. Energy and environmental issues have become the biggest constraint to the sustainable development of China's economy and society. The "11th Five-Year Plan" for Renewable Energy indicates that the new energy and renewable energy industry development plan for 2000-2015 indicates that China should solve the energy problem, and the way to change the ecological environment is to develop renewable energy. The western region of our country is located in the western part of our country. The ecological environment is fragile and the economic development is backward. Especially, the poor areas and minority areas still live on traditional biomass energy, which is not only low energy efficiency, but also causes environmental pollution. However, there are abundant renewable energy resources in the western region, which are clean and pollution-free, and vigorously promote the development and utilization of clean renewable energy sources such as solar energy and biomass energy in the western region according to local conditions. It can not only solve the problem of energy shortage in the western region, but also reduce the environmental damage and stimulate the economic development. It can be said that one can do more with one stone. Moreover, promoting the development and utilization of renewable energy in the western region is the implementation of energy saving and emission reduction in our country. The objective requirement of building a resource-saving and environment-friendly society is the inevitable choice for the construction of ecological civilization and the construction of new countryside in China. The compulsory legal means are the fundamental guarantee to promote the vigorous development of renewable energy industry. Therefore, to promote the development and utilization of renewable energy in the western region, it is necessary to perfect the legal system. At present, there are many researches on the legislation of renewable energy in China, but there are few studies on the laws and regulations of the development and utilization of renewable energy in the western region. This paper is based on the western part of our country, and through the analysis and comparison of the relevant laws and regulations at home and abroad, According to the existing problems in the legislation of renewable energy in our country and the western region, some suggestions are put forward to promote the development and utilization of renewable energy in the western region of China.
