我国环境保护法庭建设之研究

【摘要】：随着我国工业化程度的稳步提高,经济的高速发展与资源、环境的矛盾日益尖锐,由于环境案件的数量也日益增多,政府与公众的环境保护意识逐渐的增强。如何及时、准确、有效的处理日渐飙升的环境案件,成为我国环境司法领域亟待解决的问题。目前,我国各级政府都设立了不同形式的环境保护机构,对环境纠纷的处理起到了很大作用,但是,仅仅依靠环保部门处理日益增多的环境案件存在许多弊端。为了更有效地执行国家的环境保护法律、法规,发挥法律手段在环境保护中的特殊作用。在传统的民庭、刑庭和行政庭日益完善的同时,建立以环境保护宗旨的环保法庭迫在眉睫。本文认为,我国除了要进一步加强环境执法外,还需考虑在各级人民法院设立新的审判机构——环境保护审判庭。国内有不少学者对环保法庭的建设予以了高度重视,对环保法庭的运行的现状进行分析并提出建设性意见。但其成果是否在更大范围内被广泛验证及可操作性还有待进一步实践考验。本文以紫金矿业有限公司环境侵权个案为切入点,概述了当前国内环保法庭的设置和运行现状,并总结出当前环保法庭实践中其设置及运行过程中出现的问题及原因。并借鉴西方国家在环保法庭建设中的方面的成功做法和经验,特别是在处理跨区域环境纠纷、应对环境案件的专业性和借用较高级别的法院审级的优秀启示,最终提出适合我国环保法庭建设的构想。
[Abstract]:With the steady improvement of industrialization in our country, the rapid development of economy and the contradiction between resources and environment are becoming increasingly sharp. As the number of environmental cases is also increasing, the awareness of environmental protection between the government and the public is gradually strengthened. To deal with the soaring environmental cases effectively has become an urgent problem in the field of environmental justice in China. At present, our governments at all levels have set up different forms of environmental protection institutions, which have played a great role in the handling of environmental disputes, but, There are many disadvantages in relying solely on the environmental protection department to deal with the increasing number of environmental cases. In order to more effectively enforce the national environmental protection laws and regulations, and give play to the special role of legal means in environmental protection. While the criminal court and the administrative court are becoming more and more perfect, it is urgent to establish an environmental protection court for the purpose of environmental protection. This paper holds that in addition to further strengthening environmental law enforcement in our country, It is also necessary to consider setting up a new judicial body, the Environmental Protection trial Chamber, in people's courts at all levels. Many domestic scholars have attached great importance to the construction of environmental protection courts. This paper analyzes the current situation of the operation of environmental courts and puts forward some constructive suggestions. However, whether the results are widely verified and operable in a wider scope remains to be further tested in practice. Based on the case of environmental infringement in Zijin Mining Co., Ltd., this paper summarizes the current situation of setting up and running of domestic environmental protection court. The problems and reasons in the establishment and operation of environmental courts are summarized, and the successful practices and experiences of western countries in the construction of environmental protection courts are used for reference, especially in dealing with cross-regional environmental disputes. To deal with the professional nature of environmental cases and to borrow the excellent enlightenment of the higher level courts, the author finally puts forward the idea of building the environmental protection courts in our country.
