构建环境损害立体赔偿模式

【摘要】： 近年来,随着我国经济的飞速发展,环境污染问题已经成为政府和公众关注的重大民生问题。环境污染导致了生态环境的恶化,不仅造成了巨大的经济损失,也给公众的生存环境和健康带来了很大影响。目前,由于相关的环境污染损害赔偿制度还很不完善,大量环境污染受害者得不到及时有效的赔偿,污染者也往往因为无力承担相关责任而破产。鉴于此,笔者通过分析近年来我国发生的重大环境污染事件的处理和赔偿情况,研究和比较国外环境污染事件的处理和损害赔偿制度,拟构建一套适合我国国情的环境损害赔偿模式。本文采用实证分析的方法,对近两年发生的重大环境污染事故的损害赔偿情况进行了分析,认为现行的环境损害赔偿法律制度存在公共环境权利主体缺位、损害赔偿无法及时充分赔偿、污染的责任人责任过于巨大、缺乏社会化分担制度等问题；通过对比研究美国、德国、日本的环境损害赔偿制度,提出了建立“环境损害立体赔偿模式”对现存的环境损害赔偿制度进行补充的建议,并就“环境损害赔偿立体模式”的构成、赔偿制度的资金来源、分担方式、赔偿对象和赔偿程序等问题提出了具体的建议,期望通过对“环境损害立体赔偿模式”的设计来解决环境污染损害赔偿中存在的问题。
[Abstract]:In recent years, with the rapid development of China's economy, environmental pollution has become a major livelihood issue of concern to the government and the public. Environmental pollution has led to the deterioration of the ecological environment, not only caused huge economic losses. It also has a great impact on the living environment and health of the public. At present, because the relevant compensation system for environmental pollution damage is still very imperfect, a large number of victims of environmental pollution do not receive timely and effective compensation. In view of this, the author analyzes the treatment and compensation of major environmental pollution incidents that have occurred in China in recent years. This paper studies and compares the treatment and compensation system of environmental pollution events in foreign countries, and sets up a suit of environmental damage compensation model suitable for the national conditions of our country. In this paper, the author analyzes the damage compensation situation of the major environmental pollution accidents in recent two years by using the method of empirical analysis, and concludes that the current legal system of environmental damage compensation has the absence of the subject of public environmental rights. Damage compensation cannot be fully compensated in a timely manner, the liability of those responsible for pollution is too great, and there is a lack of socialized sharing system. Through a comparative study of the environmental damage compensation systems in the United States, Germany, and Japan, This paper puts forward the suggestion of establishing "three-dimensional compensation model for environmental damage" to supplement the existing system of compensation for environmental damage, and puts forward some suggestions on the constitution of "three-dimensional model of compensation for environmental damage", the source of funds of the compensation system, and the way of sharing the compensation system. This paper puts forward some concrete suggestions on compensation object and compensation procedure, and expects to solve the problems existing in the compensation for environmental pollution damage through the design of "three-dimensional compensation model for environmental damage".
