【摘要】： 农民环境知情权是指农民收集、知晓和了解与环境问题和环境政策相关的信息的权利。对农民环境知情权的保护是实现农民环境参与权和监督权的前提和基础,是顺利解决农村环境问题的必要保障。采取相应的措施保障农民环境知情权,对于新时期保障农民根本利益和社会主义新农村建设具有重要的理论意义和现实意义。我国的法律制度在保护农民环境知情权方面存在着许多的不足：对农民环境知情权保护的相关规定缺位,农村环境执法体制不健全,农民环境知情权受到侵犯后的法律救济制度也不完善,农民的环境知情权往往被忽视或任意践踏。国际组织以及美国、欧盟、俄罗斯等国家,在保护农民环境知情权方面有很多的成功经验,对完善我国的农民环境知情权法律保护制度具有重要的借鉴意义。我国农民环境知情权的保护,必须充分考虑到农村社会以及农民群体的具体特点。加强农村、农业立法,进一步完善环境信息公开制度；改进农村环境监管体制,更新农村环境执法理念和手段,强化政府责任；建立环境公益诉讼制度,丰富农民环境知情权非诉救济途径,加强农村环境法律援助。要综合各方面条件和力量,针对农村和农民的特点提出一套系统的解决方案。
[Abstract]:Farmers' right to know about the environment is the right of farmers to collect, know and understand information related to environmental problems and environmental policies. The protection of farmers' right to know about the environment is the premise and foundation of realizing farmers' right to participate in and supervise the environment. It is necessary to solve the environmental problems in rural areas smoothly. It is of great theoretical and practical significance to take corresponding measures to protect the farmers' right to know about the environment for the protection of the fundamental interests of farmers and the construction of new socialist countryside in the new period. The legal system of our country has many deficiencies in protecting the farmers' right to know about the environment: the relevant provisions on the protection of the farmers' right to know about the environment are absent, and the system of enforcing the law of the rural environment is not perfect. The legal relief system after the violation of the farmers' right to know about the environment is also imperfect. The farmers' right to know about the environment is often ignored or trampled on arbitrarily. International organizations, as well as the United States, the European Union, Russia and other countries, There are many successful experiences in protecting farmers' environmental right to know, which is of great significance for perfecting the legal protection system of peasants' right to know about the environment. We must take full account of the specific characteristics of rural society and peasant groups, strengthen rural and agricultural legislation, further improve the system of environmental information disclosure, improve the rural environmental supervision system, and update the concept and means of rural environmental law enforcement. Strengthening government responsibility, establishing environmental public interest litigation system, enriching farmers' environmental right to know, not suing relief channels, strengthening rural environmental legal aid, integrating all aspects of conditions and forces, According to the characteristics of rural areas and farmers, a set of systematic solutions are put forward.
