京津冀雾霾治理法治保障研究

【摘要】：经济发展势必会对环境造成一定的污染,工业革命以来,几乎世界上所有的工业化国家都不同程度的遭受过空气污染,但是,京津冀地区的雾霾污染程度之重、持续时间之长、牵涉范围之广、治理难度之大,举世少有。如何协调经济发展与环境保护是需要迫切解决的问题,雾霾污染的频发让人们认识到人与环境和谐相处、科学发展的重要性,经济发展不能靠环境的牺牲,雾霾污染的区域性明显,区域合作治理是处理雾霾严重现状的重要途径。京津冀地区当前粗放式发展以及分而治之、各自为政的环保标准是解决环境污染问题的羁绊,使得环境保护和能源高效利用大打折扣。改善京津冀地区大气环境质量已不是一城一地一个行业的事,必须区域协同治理,要在现有的法治保障之下,借鉴国外治理大气污染的相关经验,及时修订适合京津冀地区的大气污染防治条例,通过法律的权威性、稳定性以及政府依法行政理念的贯彻实施,达到有效解决地区利益冲突不断的问题,为京津冀地区雾霾防治协同发展在法律层面上提供指导依据。本文在目前研究京津冀一体化的热点中,对京津冀一体化中雾霾治理的法治保障进行研究,具有现实针对性,从京津冀地区严重的雾霾污染和法治现状着手,进而提出现有法治保障存在的相关问题和完善的必要性,目前,京津冀地区已经形成了固定的立法模式,通过对现有的立法模式进行分析,发现了许多弊端和具有的落后性,京津冀雾霾治理,首要任务就是加快健全法治保障,这关系到治理工作是否有法律依据和实施前提。在健全京津冀雾霾治理法治保障过程中,可以学习借鉴美国"州际协定模式"、日本"跨区域行政协调模式"和欧盟"环境委员会",发达国家的治理经验不一定能适合我国国情,但是可以因地适宜的进行筛选甄别,最后提出了笔者对京津冀雾霾治理完善法治保障的相关建议和思考,希望可以为我国的雾霾治理工作提供参考,通过完善法治保障京津冀雾霾治理工作的合理规划,最终解决京津冀面临的严重污染问题。
[Abstract]:Economic development is bound to cause certain pollution to the environment. Since the industrial revolution, almost all industrialized countries in the world have suffered from air pollution to varying degrees. However, the degree of haze pollution in the Beijing-Tianjin-Hebei region is heavy and lasts for a long time. How to coordinate economic development and environmental protection is an urgent problem that needs to be solved urgently. The frequent occurrence of haze pollution makes people realize the importance of people living in harmony with the environment and scientific development. Economic development can not depend on the sacrifice of environment, the regional pollution of haze is obvious, regional cooperative management is an important way to deal with the serious situation of haze. Separate environmental protection standards are the fetters of solving environmental pollution problems, which make environmental protection and efficient use of energy greatly reduced. Improving the atmospheric environmental quality in the Beijing-Tianjin-Hebei region is no longer a matter of one city, one city, one industry, and must be managed in a coordinated manner. Under the protection of the existing rule of law, we should learn from the relevant experience of foreign countries in controlling air pollution, revise in time the air pollution prevention and control regulations suitable for the Beijing-Tianjin-Hebei region, and adopt the authority and stability of the law, as well as the implementation of the government's concept of administration according to law. The aim of this paper is to effectively solve the continuous conflicts of interest in the region, and to provide the legal basis for the coordinated development of haze prevention and control in the Beijing-Tianjin-Hebei region. This paper studies the rule of law guarantee of haze governance in the integration of Beijing, Tianjin and Hebei, and points out the serious haze pollution and the present situation of the rule of law in Beijing-Tianjin-Hebei area, and then puts forward the related problems and the necessity of perfecting the existing rule of law protection. At present, the Beijing-Tianjin-Hebei region has formed a fixed legislative model, through the analysis of the existing legislative model, found a lot of shortcomings and backwardness, Beijing-Tianjin-Hebei haze governance, the first task is to accelerate the improvement of the rule of law protection. This is related to whether there is a legal basis and a prerequisite for the implementation of governance. In the process of improving the rule of law in the governance of Beijing-Tianjin-Hebei haze, We can learn from the "interstate agreement model" of the United States, the "cross-regional administrative coordination model" of Japan and the "environmental committee" of the European Union. The governance experience of developed countries may not necessarily be suitable for China's national conditions, but it can be screened and screened because of its suitability. Finally, the author puts forward some suggestions and thoughts on how to improve the governance of Beijing-Tianjin-Hebei haze, hoping to provide reference for our country's haze governance, and to ensure the reasonable planning of Beijing-Tianjin-Hebei haze governance by perfecting the rule of law. Finally solve the serious pollution problem that Beijing, Tianjin and Hebei face.
