论生态法治建设视野下的环境警察制度——以制度建立的客观性与主观性为视角

【摘要】：现代环境警察制度是我国生态法治建设的重要组成部分,是最严格环境保护制度的具体体现之一。它的建立对于维护国家环境秩序,保卫国家环境安全,震慑、遏制破坏环境与资源保护的违法犯罪行为具有不可替代的作用。以哲学视角观之,环境警察制度就其本质来说属于历史、关系和规范的范畴。我国建立环境警察制度具有客观必然性及独立性。环境警察制度的具体形式、具体内容以及能否发挥相应的作用有着强烈的主观性,即体现为环境警察制度的可选择性及可设计性。在此前提下我国环境警察制度必须找准其定位,才能切实发挥其在国家环境监管体系中无以替代的作用。
[Abstract]:The modern environmental police system is an important part of the construction of ecological rule of law in China and one of the most stringent environmental protection systems. Its establishment is a deterrent to the maintenance of national environmental order and the protection of national environmental security. It is irreplaceable to suppress the illegal and criminal acts that destroy the environment and protect the resources. From the perspective of philosophy, the environmental police system belongs to the history in its essence. The establishment of environmental police system in our country has objective inevitability and independence. The concrete form, concrete content and corresponding function of environmental police system have strong subjectivity. Under this premise, the environmental police system in our country must find its position correctly, in order to give full play to its role in the national environmental supervision system.
