我国环境行政责任制度的发展及完善

【摘要】：环境行政责任是我国在治理环境污染和生态破坏方面的一种责任追究处罚制度,针对不同的行为主体,进行相应的制裁和处罚。其治理环境问题效果明显,违法行为追究责任明确严厉,因而引起人们的普遍关注和社会的广泛重视。新时期我国环境行政责任制度新发展有着现实的客观必要性,能够有效规范治理环境问题,并为我国环境保护事业健康有序发展提供重要法律制度保障。本文研究我国环境行政责任制度新发展,从环境行政责任基本理论出发,归纳梳理出环境行政责任制度的不同行为主体,即环境行政管理主体与环境行政管理相对人,以这两个不同主体作为主线进行研究。在法律层面,重点对环境行政管理相对人进行规制,对新增法律条文进行分析,在肯定其所取得成绩的前提下,对其不足之处进行规范细化,以便更好的在现实生活中运用与执行;在相关制度完善层面,对环境行政管理主体进行规范指导,结合相关新制度对我国环境行政责任制度进行不断发展完善。本文研究我国环境行政责任制度是从广义的角度出发,包含法律层面和制度层面,并使二者有机统一结合起来,目的在于不断规范发展我国环境行政责任制度,进而促进我国环境保护法律体系的构建,监督政府部门在环境保护执法中的职责和督促企业生产观念的转变,共同促使我国生态文明建设与环境保护事业在新时期健康有序的发展和规范有效的运行。
[Abstract]:Environmental administrative responsibility is a system of accountability and punishment for environmental pollution and ecological damage in our country, which carries out corresponding sanctions and penalties for different actors. It is clear and strict to investigate the responsibility for illegal acts, which causes people's general concern and social attention. In the new period, the new development of environmental administrative responsibility system in our country has realistic objective necessity, and can effectively regulate and govern environmental problems. It also provides an important legal system guarantee for the healthy and orderly development of environmental protection in China. This paper studies the new development of environmental administrative responsibility system in China, and proceeds from the basic theory of environmental administrative responsibility. This paper summarizes and sorts out the different actors of environmental administrative responsibility system, that is, the subject of environmental administration and the relative person of environmental administration, taking these two different subjects as the main line of study. The emphasis is on the regulation of the relative person of the environmental administration, the analysis of the new legal provisions, and the standardization and refinement of its deficiencies on the premise of affirming its achievements, in order to better use and implement in real life; At the level of relative system perfection, we should standardize and guide the subject of environmental administration, and develop and perfect the system of environmental administrative responsibility in our country with the combination of relevant new system. This paper studies the system of environmental administrative responsibility in our country from the broad sense of view. It includes the legal level and the institutional level, and organically unifies them in order to standardize and develop the system of environmental administrative responsibility in our country, and then to promote the construction of the legal system of environmental protection in our country. Supervision of the responsibilities of government departments in the enforcement of environmental protection and supervision of the transformation of the concept of production of enterprises to jointly promote the construction of ecological civilization and environmental protection in the new period of healthy and orderly development and standardized effective operation.
