京津冀重污染区域环境协同治理的法律保障研究

【摘要】：近几年的环境监测数据表明,京津冀区域的各项环境污染指标远远高于全国其他地区。在全国城市空气质量排名最后10位的城市中,京津冀区域的13个城市基本上要占据6个~8个席位。京津冀区域环境污染日益严重的现状,要求京津冀三省市在环境治理方面必须通力合作,通过协同治理使该地区的环境质量取得根本性改善。京津冀区域环境协同治理也面临着许多制约因素,如地方政府环境治理目标的偏好不同、区域内环境治理的法律规范不统一、环境监管分别执法、环境协同治理缺乏制度性保障等。为了使京津冀区域环境协同治理达到预期目标,应着力统一区域内环境治理规范,建立区域内环境信息共享机制和环境监管联合执法机制,完善区域内生态环境补偿制度并明确地方政府的责任。
[Abstract]:Environmental monitoring data in recent years have shown that environmental pollution indicators in the Beijing-Tianjin-Hebei region are far higher than in the rest of the country. The 13 cities in the Beijing-Tianjin-Hebei region basically occupy six to eight seats. The increasing environmental pollution in the Beijing-Tianjin-Hebei region requires the three provinces and cities of Beijing, Tianjin and Hebei to cooperate in environmental management. The environmental quality of this area has been improved fundamentally by collaborative governance, and the Beijing, Tianjin and Hebei regions also face many constraints, such as the different preferences of local governments' environmental governance objectives. The laws and regulations of environmental governance in the region are not unified, the environmental supervision and control are carried out separately, and the environmental cooperative governance lacks institutional protection. In order to achieve the expected goal of the environmental cooperative governance in the Beijing-Tianjin-Hebei region, it is necessary to make efforts to unify the environmental governance norms in the region. The environmental information sharing mechanism and the joint law enforcement mechanism of environmental supervision in the region should be established to perfect the ecological environment compensation system in the region and to clarify the responsibility of the local government.
