【摘要】： 实现代际公平是人类社会持续发展的重要要求,人类必须尽最大的可能来充分估计自身行为后果,对后代负责也是对自己负责。由于代际公平理论要求在一定程度上限制本代人的行为活动,与人类社会传统的社会价值观有本质上的冲突,故绝非朝夕之间就能实现代际公平。在我国,古人很早就显示出超前的代际公平观念,提出“周而复始”“天人合一”的要求,但那时的观念是朴素的,也不存在实现代际公平的必要现实基础。直到20世纪,严峻的环境问题现状引发了意识上的觉醒,西方学者开始系统地提出并阐述代际公平理论,如果本代人的行为活动一再影响后代人的生活质量,留给后人的将是一个满目苍痍的地球,于是,以美国为代表的一些国家纷纷对代际公平理论进行了立法,试图从法律规制的角度确立代际公平的地位,国际上也出现保护后代人利益的司法实践。在我国,代际公平在环境法中的地位比较模糊,而且代际公平法律化面临来自传统价值观、法律表达形式和传统法律思维的阻碍,我国可以在宪法和环境法中确立代际公平的地位,以促进代际公平法律化,同时进一步完善代际公平自身理论建设,为代际公平理念的实现确定具体操作的标准,落实到环境保护的实践。
[Abstract]:The realization of intergenerational equity is an important requirement for the sustainable development of human society. Human beings must fully estimate the consequences of their own behavior as far as possible and be responsible for their future generations as well as themselves.Because the theory of intergenerational equity requires to restrict the behavior of the current generation to a certain extent and conflicts with the traditional social values of human society, it is not possible to realize intergenerational justice overnight.In our country, the ancients showed the concept of intergenerational justice in advance very early, and put forward the requirement of "the unity of nature and man", but the idea at that time was simple, and there was no necessary realistic foundation to realize the intergenerational justice.Until the 20th century, severe environmental problems caused a conscious awakening, Western scholars began to systematically put forward and elaborate the theory of intergenerational equity, if the behavior of the current generation repeatedly affects the quality of life of future generations.As a result, some countries, represented by the United States, legislated on the theory of intergenerational equity and tried to establish the status of intergenerational equity from the angle of legal regulation.There is also an international judicial practice to protect the interests of future generations.In China, the status of intergenerational equity in environmental law is rather vague, and the legalization of intergenerational equity faces obstacles from traditional values, forms of legal expression and traditional legal thinking.China can establish the status of intergenerational equity in the constitution and environmental law in order to promote the legalization of intergenerational equity, and at the same time, further improve the theoretical construction of intergenerational equity, and set the specific operating standards for the realization of the concept of intergenerational equity.To implement the practice of environmental protection.
