检察机关支持环境民事公益诉讼制度研究

【摘要】：“司法是社会正义的最后一道防线”，在环境污染与破坏问题日益显现的今天，为环境公共利益的实现提供全方位的救济途径，完善侵害环境公共利益的解决机制，建立环境民事公益诉讼成为最佳方式。地方检察机关根据各地的实际参与环境公益诉讼，开展了一系列的有效的实践和探索，取得了一定的成效。其中最为常见的方式即是检察机关支持环境民事公益诉讼。论文内容由四章组成，第一章为检察机关支持环境公益民事诉讼制度的基本理论，，旨在明确检察机关支持环境民事公益诉讼的涵义、特征及其必要性；第二章介绍该项制度的演变及现状；第三章是从目前的现状着手，指出存在的问题；第四章是在前文的基础上提出完善建议，更好的解决已有的诉讼问题。
[Abstract]:"Justice is the last line of defense of social justice". Today, the problem of environmental pollution and destruction is becoming more and more obvious, which provides a comprehensive relief way for the realization of environmental public interest, and consummates the solving mechanism of encroaching on environmental public interest.Establishing environmental civil public interest litigation is the best way.The local procuratorial organs have carried out a series of effective practices and explorations according to the actual situation of participating in environmental public interest litigation and achieved certain results.Among them, the most common way is that the procuratorial organ supports the environmental civil public interest litigation.The thesis consists of four chapters. The first chapter is the basic theory of procuratorial organ supporting the environmental public interest civil litigation system, in order to clarify the meaning, characteristics and necessity of the procuratorial organ supporting the environmental civil public interest litigation.The second chapter introduces the evolution of the system and the current situation; the third chapter is from the current situation, pointing out the existing problems; the fourth chapter is on the basis of the previous suggestions to improve the better solution to the existing litigation problems.
