上海合作组织框架内能源合作法律机制构建研究

【摘要】： 上海合作组织成立的初衷是为了维护地区的和平、安全与稳定。但近年来,上海合作组织各成员国都开始重视经济贸易方面的合作,而其中能源的合作又显得尤为迫切和重要。本文的选题目的就是希望在这样的时代背景下,通过在上海合作组织框架内构建能源合作法律机制,来促进和保障上海合作组织各成员国间的能源合作,从而带动本区域经济贸易合作的深入发展,这样不仅符合各成员国的利益,也有利于增强上海合作组织的活力。本文采用实证研究、对比分析和归纳总结等方法,并综合运用法学、政治学和经济学等相关理论知识,从多角度多方位分析上海合作组织内能源合作的现状,论证在上海合作组织框架内构建能源合作法律机制的必要性与可行性,借鉴国际能源合作法律机制实践中的经验,大胆设想,在上海合作组织框架内达成基本协议,设置专门机构,建立健全其他相关法律制度,从而构建一套合理高效的能源合作法律机制。
[Abstract]:The original intention of the SCO was to maintain regional peace, security and stability.However, in recent years, SCO members have begun to attach importance to economic and trade cooperation, among which energy cooperation is particularly urgent and important.The purpose of this paper is to promote and protect the energy cooperation among the SCO member states through the establishment of a legal mechanism for energy cooperation within the framework of the Shanghai Cooperation Organization against this background of the times.Thus, the further development of regional economic and trade cooperation is not only in the interests of the member countries, but also conducive to enhancing the vitality of the Shanghai Cooperation Organization.This paper adopts the methods of empirical research, comparative analysis and summing up, and synthesizes the relevant theoretical knowledge of law, political science and economics to analyze the current situation of energy cooperation in the Shanghai Cooperation Organization from many angles and various aspects.To demonstrate the necessity and feasibility of establishing a legal mechanism for energy cooperation within the framework of the Shanghai Cooperation Organization, to draw lessons from the experience in the practice of the legal mechanism of international energy cooperation, and to make bold assumptions to reach a basic agreement within the framework of the Shanghai Cooperation Organization.Set up specialized agencies, establish and perfect other relevant legal systems, and build a set of reasonable and efficient legal mechanism for energy cooperation.
