【摘要】： 在各国的环境保护实践中,预防观念越来越重要。以预防功能为核心的环境行政规划制度也日益受到重视并发挥着越来越重要的作用。目前在我国,对于环境行政规划来说,学术界对环境行政规划的认识并不统一,导致有关环境行政规划的完整理论体系尚未形成;有关环境行政规划立法上的滞后,也在一定程度上影响了环境行政规划应有的权威性、严肃性和实施效果;理论和立法的滞后,直接影响了环境行政规划实践的效果。因此,对环境行政规划展开详细的研究是非常有必要的,不仅有助于对环境行政规划加强认识、深化理解,也为今后有关环境行政规划的立法和实施奠定理论基础。本文首先从环境行政规划的涵义、性质及其在我国的地位上对环境行政规划进行初步的分析,具体研究了什么是环境行政规划,环境行政规划的具体性质是什么,环境行政规划在我国的地位如何。其次,介绍了环境行政规划在我国的具体发展历程,包括最初的孕育阶段、不断的探索阶段和逐步的发展阶段。再次,本文对环境行政规划所应遵循的原则进行了研究,在其基本原则的基础上,重点研究环境行政规划所应遵循的符合其自身特色的原则。再次,本文分别从环境行政规划的学术研究、法律依据以及编制与实施方面对我国环境行政规划的现状及其存在的问题进行了分析。最后,本文对我国环境行政规划提出了一些可行性的建议,包括完善环境行政规划体系、建立健全环境行政规划的法定程序以及健全环境行政规划的救济体系三个方面的内容。
[Abstract]:In the practice of environmental protection in various countries, the concept of prevention is becoming more and more important. The environmental administrative planning system with prevention function as the core is paid more and more attention and plays an increasingly important role. At present, for environmental administrative planning in China, the understanding of environmental administrative planning in academic circles is not uniform, resulting in the formation of a complete theoretical system of environmental administrative planning, the lagging of legislation on environmental administrative planning, To some extent, it also affects the authority, seriousness and implementation effect of environmental administrative planning, and the lag of theory and legislation directly affects the effect of environmental administrative planning practice. Therefore, it is necessary to carry out detailed research on environmental administrative planning, which is not only helpful to strengthen the understanding and deepen the understanding of environmental administrative planning, but also lays a theoretical foundation for the legislation and implementation of environmental administrative planning in the future. In this paper, the meaning and nature of environmental administrative planning and its status in our country are analyzed at first, and what is environmental administrative planning and what is the specific nature of environmental administrative planning are studied in detail. What is the status of environmental administrative planning in our country? Secondly, it introduces the specific development course of environmental administrative planning in China, including the initial gestation stage, the continuous exploration stage and the gradual development stage. Thirdly, this paper studies the principles that should be followed in the environmental administrative planning. On the basis of its basic principles, it focuses on the principles that should be followed by the environmental administrative planning in accordance with its own characteristics. Thirdly, this paper analyzes the current situation and existing problems of environmental administrative planning in China from the aspects of academic research, legal basis, compilation and implementation of environmental administrative planning. Finally, this paper puts forward some feasible suggestions on environmental administrative planning of our country, including perfecting the system of environmental administrative planning, establishing and perfecting the legal procedure of environmental administrative planning and perfecting the relief system of environmental administrative planning.
