海域使用权的界定

【摘要】：权利的界定不同于权利的定义,权利的界定倾向于把握定义的外延,通过多角度的分析比较把握不同权利之间的区别。作为一个具体的权利类别,海域使用权的界定可通过主体、客体、内容、性质等角度展开,其中客体的界定是海域使用权界定的基础,客体的界定可分为横纵两个方面,横向上包括内水和领海,其中,滩涂应属于海域范围；纵向上包括水面、水体、海床和底土,其中水面是指水面及其上空一定空间。海域使用权的权利界定主要把海域使用权与土地使用权、水权、渔业权、海域承包经营权进行比较,其中,与土地使用权、水权的比较主要立足客体角度,与渔业权、海域承包经营权主要从权利本身分析。最后,提出了海域使用权的新界定——海域分层确权制度的构建,重点放在海域分层确权的立法设计、登记、相邻关系的构建等方面。
[Abstract]:The definition of the right is different from the definition of the right. The definition of the right tends to grasp the extension of the definition. As a specific category of rights, the definition of the right to use the sea area can be carried out from the angles of subject, object, content and nature, among which the definition of the object is the basis of the definition of the right to use the sea area, and the definition of the object can be divided into two aspects: horizontal and vertical. Horizontally, it includes internal water and territorial sea, in which the tidal flat should belong to the sea area, and longitudinally includes the water surface, water body, sea bed and subsoil, in which the water surface refers to a certain space over the water surface and its sky. The definition of the right to use the sea area mainly compares the right to use the sea area with the right to use the land, the right to water, the right to fishery, and the right to contract management in the sea area. Sea area contract management right mainly from the right itself analysis. Finally, the paper puts forward a new definition of the right to use the sea area-the construction of the system of sea area stratification confirmation right, with emphasis on the legislative design, registration and the construction of the adjacent relationship of the sea area stratification confirmation right.
