船舶污染事故调查处理法律问题研究

【摘要】：随着我国经济的繁荣,需要越来越多的船舶营运,我国所面临的船舶污染事故风险始终存在。船舶污染事故造成的后果严重并且难以消除。一套专业的调查处理船舶污染事故的机制不仅可以尽可能消除事故本身所带来的危害,更可以使相关机关可以在事故中吸取教训,改善调查机制,通过处理相关责任方达到预防事故发生的目的。我国调查处理船舶污染事故的机制是建立的一系列法律法规授权基础之上的。用法律手段规范船舶污染事故调查处理工作,会收到良好效果。我国先后制定了《中华人民共和国海洋环境保护法》、《中华人民共和国防治船舶污染海洋环境管理条例》、《中华人民共和国防治船舶污染内河水域环境管理规定》、《船舶污染事故调查官管理规定(试行)》、《中华人民共和国海上海事行政处罚规定》以及即将生效的《船舶污染海洋环境应急防备和应急处置管理规定》等一系列法律法规,规范了我国对船舶污染事故调查处理机制。然而我国在该领域的立法尚不健全,现行船舶污染事故调查处理法律制度存在不足,导致了船舶污染事故调查处理目的在思想上不统一,在调查处理机制内很多地方仍处于法律“真空”状态。本文从船舶污染事故调查处理的法律性质入手,借鉴发达国家的在该领域的运行机制,结合我国立法和执法现状,按照行政法一般理论探讨船舶污染事故调查处理机制,找出该机制上的不足,并且提出自己的建议。
[Abstract]:With the prosperity of our country ' s economy , more and more ships are required to operate , and the risk of ship pollution accidents is always in existence . A professional investigation and treatment mechanism not only can eliminate the harm brought by the accident itself , but also can make the relevant authorities learn from the accident , improve the investigation mechanism , and deal with the relevant responsible parties to achieve the purpose of preventing accidents .

A series of laws and regulations , such as the Regulations on Environmental Management of the People ' s Republic of China on the Prevention and Control of Pollution by Ships , the Regulations on the Prevention and Control of Marine Pollution Accidents and Emergency Preparedness and Emergency Treatment Management Regulations of the People ' s Republic of China on the Prevention and Control of Pollution Accidents in China have been formulated .

Starting from the legal nature of the investigation and treatment of ship pollution accident , this paper draws on the running mechanism of the developed countries in this field , and discusses the mechanism of investigation and treatment of ship pollution accident according to the general theory of administrative law in the light of the current situation of legislation and law enforcement in China , and puts forward its own suggestions .
