【摘要】:改革开放以来,中国经济飞速发展,在物质条件十分繁荣的今天,环境污染、资源枯竭所带来的环境危机也日益突出。人们逐渐意识到绿色环保、可持续发展的重要性,因此环境保护成了全社会除了经济发展之外的另一大重要课题。公司企业的本性是追求利益最大化,单纯用道德去倡导企业尊重自然环境是不可能的,因此必须运用适当的行政管理手段以及环境经济政策来指导和约束企业的经济行为。绿色信贷政策就是在这样的背景下产生的,控制信贷就可以影响企业的经营决策行为。绿色信贷政策,简单的说就是银行等金融机构对高污染高耗能企业和项目实行贷款限制或者是实行高于市场的利率,对环保节能的企业和项目提供贷款支持并给予低于市场的利率。这项政策在金融杠杆因素的作用下,在实体经济中的影响力会成倍的扩张,引导企业走向绿色环保生产方式的道路上,进而起到帮助调整我国经济发展方式,实现可持续发展的作用。 绿色信贷在当前我国的作用毋庸置疑,并且中国已经出台了绿色信贷政策,已经取得了一定的成效,但是效果并不理想。本文的目的就是讨论将绿色信贷政策上升为法律制度的必要性和可行性,如何去构建和完善绿色信贷法律制度。具体的说,本文共分为五个部分。第一部分介绍绿色信贷的概述,包括内涵,理论基础以及在我国的现状和发展;第二部分主要介绍绿色信贷的法律化,论述了绿色信贷法律化的必要性、可行性以及绿色信贷法律制度的价值追求,法理基础;第三部分介绍了国外绿色信贷的实践经验以及对我国的启示,主要介绍了实行得比较成功的美国、英国、加拿大等国;第四部分也是本文的重点部分,对我国绿色信贷法律制度的建构和完善提出了一些对策意见。 通过分析,得出的结论是:构建和完善绿色信贷法律制度是一项系统工程,需要多个部门、采取各种措施互相配合、相互协调。首先,建立科学、完善的绿色信贷实施标准,提高该制度的可操作性;其次,完善绿色信贷的信息披露和信息沟通、共享制度,确保该制度的准确性和有效性;再次,完善政府部门职责,明确监管者的法律责任,防止监管者失职、缺位等情况的发生,保障绿色信贷法律制度的顺利实施;最后,完善与绿色信贷相关的外在保障制度。
[Abstract]:Since the reform and opening up, China's economy has developed rapidly. Today, when the material conditions are very prosperous, the environmental crisis caused by environmental pollution and resource depletion has become increasingly prominent. People gradually realize the importance of green environmental protection and sustainable development, so environmental protection has become another important subject in the whole society besides economic development. The nature of a company is to pursue profit maximization. It is impossible to advocate the enterprise to respect the natural environment with morality. Therefore, it is necessary to use appropriate administrative means and environmental economic policies to guide and restrain the economic behavior of enterprises. The green credit policy is produced under this background, controlling credit can influence the enterprise's management decision behavior. Green credit policy, in short, is that banks and other financial institutions impose loan restrictions on enterprises and projects with high pollution and high energy consumption or impose higher interest rates than the market. Provide loan support to green-energy-saving enterprises and projects and offer below-market interest rates. Under the influence of financial leverage, this policy will multiply its influence in the real economy, guide enterprises to the road of green and environmentally friendly production, and then help adjust the way of economic development in China. The role of sustainable development There is no doubt that the role of green credit in our country, and China has issued a green credit policy, has achieved some results, but the effect is not ideal. The purpose of this paper is to discuss the necessity and feasibility of raising green credit policy to legal system, and how to construct and perfect the legal system of green credit. Specifically, this paper is divided into five parts. The first part introduces the outline of green credit, including its connotation, theoretical basis, current situation and development in our country, the second part mainly introduces the legalization of green credit, and discusses the necessity of legalization of green credit. The third part introduces the practical experience of foreign green credit and its inspiration to our country, mainly introduces the successful implementation of the United States, Britain, Canada and other countries. The fourth part is also the key part of this paper, put forward some countermeasures to the construction and perfection of the green credit legal system in our country. The conclusion is that it is a systematic project to construct and perfect the legal system of green credit, which requires many departments to take various measures to coordinate and coordinate with each other. First, establish scientific and perfect green credit implementation standards to improve the operability of the system; secondly, improve the information disclosure and information communication, sharing system to ensure the accuracy and effectiveness of the system; third, Improve the responsibilities of government departments, clear the legal responsibilities of regulators, prevent the occurrence of negligence and absence of regulators, ensure the smooth implementation of the legal system of green credit; finally, improve the external protection system related to green credit.
