环境法制建设对公民环境权的保障作用

【摘要】： 目的环境保护是实现可持续发展的关键。环境权与人的生存权、健康权密不可分,保障人类环境权的实现即是其生命健康权和发展权得以实现的前提。在“依法治国”的基本方略之下,无论是环境问题的解决还是公民环境权的保障,都必须依靠完善的法治环境,有鉴于此,以“环境法制建设对公民环境权的保障作用”为题,从认识环境权入手,结合乌鲁木齐市的实际情况,分析研究环境法制建设对实现公民环境权所起的作用,并提出相应的建议。方法采用文献资料查阅、问卷调查、实地调研、数据分析等方法。结果通过对我国公民环境权法律保障现状、近几年环境质量现状和乌鲁木齐市的环境法制建设现状、环境质量现状进行分析研究,得知强化环境法制建设对改善区域环境质量、保障公民环境权益具有积极的保障和促进作用。结论我国的环境问题集中表现在环境污染与生态破坏两方面,乌鲁木齐市的环境形势同样较为严重,比较突出的是大气污染问题。从根本上遏制污染趋势,保护生态环境,保障市民身体健康,是经济和社会可持续发展的需要,也是保护公民环境权的关键。文章提出了完善环境立法、严格执法、创新行政诉讼机制、强化责任追究和法律监督、提高主体自觉意识等较为完善可行的措施与建议,对进一步建立健全环境法制体系,改善环境质量,保障市民环境权,具有一定的现实意义和理论意义。
[Abstract]:Objective Environmental protection is the key to realize sustainable development. The right to environment is closely related to the right to exist and the right to health. The realization of the right to environment is the prerequisite for the realization of the right to life and health and the right to development. Under the basic strategy of "governing the country by law", both the solution of environmental problems and the protection of citizens' environmental rights must rely on the perfect environment of the rule of law. In view of this, the theme is "the role of environmental legal system construction in protecting citizens' environmental rights". Based on the understanding of environmental rights and the actual situation of Urumqi, this paper analyzes and studies the effect of environmental legal system construction on the realization of citizens' environmental rights, and puts forward some corresponding suggestions. Methods the methods of literature review, questionnaire investigation, field investigation and data analysis were used. Results based on the analysis of the current situation of the legal protection of citizens' environmental rights in China, the present situation of environmental quality in recent years and the present situation of environmental legal system construction in Urumqi, it is found that strengthening the construction of environmental legal system can improve the regional environmental quality. Protection of citizens' environmental rights and interests has a positive role to protect and promote. Conclusion the environmental problems in China are mainly manifested in two aspects: environmental pollution and ecological destruction. The environmental situation in Urumqi is also serious, and the problem of air pollution is more prominent. It is necessary for the sustainable development of economy and society to contain the pollution trend, to protect the ecological environment and to protect the citizens' health. It is also the key to protect the citizens' environmental rights. The article puts forward some more perfect and feasible measures and suggestions, such as perfecting the environmental legislation, strictly enforcing the law, innovating the administrative litigation mechanism, strengthening the responsibility investigation and legal supervision, raising the consciousness of the subject, and so on, so as to further establish and perfect the environmental legal system. It is of practical and theoretical significance to improve environmental quality and protect citizens' environmental rights.
