论我国生态修复性司法模式的实践与完善

【摘要】：随着修复性司法在各国刑事司法实践中的不断加强,我国环境司法领域也正在引进修复性司法理念并尝试进行本土性的改良。生态修复性司法理念弥补了原有环境司法中只注重惩罚不注重激励、只注重保护不注重修复的弊端,并借助制度的顶层设计,推动生态文明建设,以实现美丽中国梦。目前,我国生态修复性司法制度的实践类型主要有政府运行模式、法院运行模式和第三方市场运行模式。对三种运行模式从理论及实践角度进行深入分析,可以发现完善我国生态修复性司法制度的现实路径,以期实现修复性理念在环境司法领域的改良与构建。
[Abstract]:With the continuous strengthening of restorative justice in the criminal justice practice of various countries, the field of environmental justice in China is also introducing the concept of restorative justice and trying to improve it locally. The idea of ecological restorative judicature makes up for the disadvantages of only paying attention to punishment and not paying attention to encouragement, only paying attention to protection and not paying attention to repair in the original environmental justice, and promoting the construction of ecological civilization with the aid of the top-level design of the system, in order to realize the beautiful Chinese Dream. At present, the practice types of ecological repair judicial system in China mainly include government operation mode, court operation mode and third party market operation mode. By analyzing the three operation modes from the angle of theory and practice, we can find the realistic way to perfect our country's ecological restorative judicial system, in order to realize the improvement and construction of the restorative concept in the field of environmental justice.
