黑龙江省发展低碳经济法律规制研究

【摘要】： 发展低碳经济是世界各国包括中国应对气候变化带来挑战的战略性选择,应当成为可持续发展战略的重心和走新型工业化道路的必然选择。低碳经济的核心是发展,发展低碳经济是一个长期的、渐进的过程,需要紧密结合中国的国情和发展阶段,兼顾国家长远和现实利益,兼顾国家战略与自身优势,兼顾节能减排与发展相互促进,通过不断的探索和实践,有计划、有步骤地实施,走出具有中国特色的低碳发展之路。本文回顾了国内外关于发展低碳经济的理论观点,详细地论述了英、德、欧、美、日等发达国家和地区以及部分发展中国家发展低碳经济的经验和模式,全面地论述了低碳经济的发展理念、发展模式、基本原则和总体思路。通过对中外发展低碳经济的比较研究,详细分析了我国发展低碳经济面临的挑战和机遇。结合黑龙江省建设“八大经济区”的战略构想,对黑龙江省的发展低碳经济的基本条件、区域特点、现实基础进行了细致分析,从黑龙江省实际出发提出了发展低碳经济的战略构想。文章着重对我国低碳经济的法律规制现状进行了总结归类,查找出了存在的法律问题,提出了构建低碳经济国家法律体系和地方法律体系的建议,力求有力促进黑龙江省经济更好更快发展。
[Abstract]:The development of low-carbon economy is a strategic choice for countries in the world, including China, to deal with the challenges posed by climate change. It should be the focus of sustainable development strategy and the inevitable choice to take the road of new-type industrialization. The core of low-carbon economy is development, and the development of low-carbon economy is a long-term and gradual process. It needs to be closely combined with China's national conditions and stages of development, taking into account the long-term and realistic interests of the country, as well as the national strategy and its own advantages. Energy conservation and emission reduction and development promote each other, through continuous exploration and practice, planned, step by step implementation, out of the road of low-carbon development with Chinese characteristics. This paper reviews the theory of developing low-carbon economy at home and abroad, and discusses in detail the experiences and models of developing low-carbon economy in developed countries and regions such as Britain, Germany, Europe, the United States and Japan, as well as some developing countries. The development concept, development model, basic principles and general ideas of low-carbon economy are discussed in detail. Through the comparative study on the development of low carbon economy at home and abroad, the challenges and opportunities of developing low carbon economy in China are analyzed in detail. Combined with the strategic conception of constructing "eight economic zones" in Heilongjiang Province, the basic conditions, regional characteristics and realistic basis for the development of low-carbon economy in Heilongjiang Province are analyzed in detail. Starting from the reality of Heilongjiang Province, the paper puts forward the strategic conception of developing low carbon economy. This paper summarizes and classifies the current situation of legal regulation of low-carbon economy in China, finds out the existing legal problems, and puts forward some suggestions for constructing the legal system of low-carbon economy countries and local legal systems. Strive to promote better and faster economic development in Heilongjiang Province.
